The People's Committee of Ha Nam province is seeking opinions on regulations on the use of motorbikes, scooters, and rudimentary vehicles for passenger and cargo transportation in the province.
One of the notable points of the draft is the regulation on vehicle drivers, including motorbike taxi drivers.
Accordingly, when using motorbikes, mopeds (motorbikes), and rudimentary vehicles for passenger and cargo transportation business, the vehicle operator must have a registration form confirmed and issued a card by the People's Committee of the commune, ward, or town where he/she resides according to the following form:
Vehicle operators must also comply with the following regulations:
Depending on the type of vehicle, the driver must comply with the provisions of Article 56 of the Law on Road Traffic Order and Safety 2024.
Drivers of rudimentary vehicles engaged in the business of transporting goods and passengers must comply with the provisions of Article 31 of the 2024 Law on Road Traffic Order and Safety.
Motorbike and motorbike drivers engaged in the business of transporting goods and passengers must comply with the provisions of Article 33 of the 2024 Law on Road Traffic Order and Safety.
Drivers of two-wheeled motorbikes, three-wheeled motorbikes, motorbikes, and motorized bicycles engaged in passenger transport business are responsible for bringing helmets for passengers; passengers transported on two-wheeled motorbikes, three-wheeled motorbikes, motorbikes, and motorized bicycles must comply with the provisions in Clause 3, Article 31 and Clause 2, Article 33 of the 2024 Law on Road Traffic Order and Safety.
The draft also stipulates that vehicle drivers have the right to refuse transportation in the following cases:
Passengers who cause public disorder on the vehicle, obstruct the activities of the driver or the transport business unit, affect the life, health and property of the driver or passengers on the vehicle; passengers who carry goods prohibited from being transported according to the provisions of law.
Goods prohibited from transportation according to the provisions of law.
Driving a vehicle when detecting that the vehicle does not meet safety conditions; lining up on the vehicle not in accordance with the law.
Passengers transported on two-wheeled motorbikes, three-wheeled motorbikes, motorbikes, and motorbikes that do not comply with the provisions of Clause 3, Article 31 and Clause 2, Article 33 of the Law on Road Traffic Order and Safety 2024.
Drivers must not refuse to transport passengers or goods, except for the reasons specified in Clause 6 of this Article; must be responsible for assisting passengers; must have a civilized and polite service attitude; must be responsible for providing first aid to passengers showing signs of illness or childbirth; must wear neat and clean uniforms in accordance with local customs and practices; must not transfer passengers or goods to another vehicle without the consent of the passenger or the person hiring the transport, except in cases of force majeure.
