The Legal Consulting Department of Lao Dong Newspaper said that Article 19, Circular 108/2026/TT-BCA of the Ministry of Public Security (effective from July 1, 2026) stipulates the issuance of driver's licenses as follows:
1. The Traffic Police Department issues electronic driving licenses to people who pass the driving test results and integrates them into the electronic data system within 2 hours from the time of completion of the driving test.
In case people have a need to issue a driver's license made of PET material, the Traffic Police Department or the Traffic Police Department shall organize the printing and return of the driver's license within 3.5 working days, from the date of completion of the driving test; the return of the driver's license to the person who achieves the driving test results shall be carried out at the Traffic Police Department or through training institutions (if any), testing centers or through postal services at the request of individuals.
2. The issuance of driver's licenses to people with car driver's licenses of all classes that have expired; loss of car driver's licenses and those driver's licenses that have expired, including people with military driver's licenses issued by the Ministry of National Defense, driver's licenses in the People's Police when they are no longer performing national defense and security duties, shall be carried out as follows:
a) People with driver's licenses in the above cases must have their names in the driver's license information system at the Traffic Police Department or the list of driver's licenses issued (management book), in case the military driver's license issued by the Ministry of National Defense is lost, they must have confirmation from the issued agency, then take the following contents:
- In case the driver's license is overdue from 30 days to less than 1 year from the expiration date to the time of submitting a valid dossier, it must have a theoretical test to be issued a driver's license according to the provisions of point a, clause 1, Article 4 of this Circular.
- In case the driver's license is overdue for 1 year or more from the expiration date, it is necessary to conduct theoretical and practical driving tests in the field and on the road to issue a driver's license according to the provisions of Clauses 1, 2, 3, Article 4 of this Circular.
- The dossier requesting the examination shall be implemented according to the provisions of Clause 3, Article 16 of this Circular;
b) People with driver's licenses specified in point a of this clause who need to review must register with driving training institutions or driving test centers to be guided in reviewing;
c) In case a person with a driver's license specified in point a of this clause fails the test, if they have the need, register with the Traffic Police Department to participate in the re-test.
3. Have not conducted a driver's license test for people who violate the law on road traffic order and safety and have not completed the requirements of competent state agencies on resolving and handling administrative violations in the field of road traffic order and safety.
