Penalty for not having a motorbike emission inspection certificate

According to new regulations, vehicle owners who do not have a motorbike emission inspection certificate will be fined.

Point b, Clause 1, Article 32 of Decree No. 168/2024/ND-CP stipulates a fine of VND 200,000 to VND 300,000 for individuals and VND 400,000 to VND 600,000 for organizations that are owners of motorbikes, mopeds (motorbikes) and similar vehicles to motorbikes, and similar vehicles to mopeds that commit one of the following violations:

Driving a vehicle without a motorcycle or motorbike emission inspection certificate or with one that has expired or using a motorcycle or motorbike emission inspection certificate not issued by a competent authority.

Although there are regulations on fines for motorbike emission inspection, this regulation will not be implemented from January 1, 2025.

Clause 2, Article 53 of Decree 168 (effective) stipulates as follows: The provisions at Point b, Clause 1, Article 32 of this Decree shall take effect according to the provisions of the law on environmental protection on emission inspection of motorbikes and mopeds.

Regarding the roadmap for motorbike emission inspection, the Ministry of Transport previously responded to voters that emission inspection for motorbikes in circulation is not mandatory from January 1, 2025, but is implemented according to the Prime Minister's Decision regulating the roadmap for applying emissions of road motor vehicles in circulation (roadmap).

Regarding preparation and congestion avoidance at emission testing facilities. Pursuant to the Law on Road Traffic Order and Safety, the Ministry of Transport has proactively developed relevant legal documents to prepare for motorcycle emission testing as follows:

Submit to the Government for consideration and promulgation of a Decree regulating the business conditions of motor vehicle inspection services; organization and operation of inspection facilities; and the life span of motor vehicles. Including regulations on the operating conditions of facilities for inspection of emissions of motorbikes and mopeds.

Issue 03 Circulars under authority:

Circular regulating the procedures for granting new, re-granting, temporarily suspending operations, and revoking certificates of eligibility for motor vehicle inspection activities of motor vehicle inspection establishments and motorcycle and motorbike emission inspection establishments.

Circular regulating the order and procedures for inspection and exemption from first-time inspection for motor vehicles and specialized motorbikes; the order and procedures for certification of technical safety and environmental protection for converted motor vehicles and modified specialized motorbikes; the order and procedures for inspection of exhaust emissions of motorbikes and mopeds.

Circular promulgating National technical regulations on technical facilities and locations of motor vehicle inspection facilities, and motorcycle and motorbike emission inspection facilities.

Thus, the Ministry of Transport has submitted to the Government for promulgation and promulgated under its authority legal documents ready for the inspection of emissions of motorbikes and scooters in circulation.

In the coming time, the Ministry of Transport will closely coordinate with the Ministry of Natural Resources and Environment to complete the Roadmap to submit to the Prime Minister; at the same time, carry out propaganda, dissemination, and organize training for inspectors, professional staff, etc. so that agencies, organizations, and enterprises have time to prepare technical facilities and human resources to reduce possible congestion at inspection facilities.

Thus, the authorities are building a roadmap for inspection of emissions of motorbikes in circulation. When there is an official decision on the roadmap, the regulations on fines for violations of motorbike emission inspection will take effect.
