The Ministry of Public Security is seeking comments until October 1, 2024 on the Draft Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points and restoration of points on driving licenses.
For the fault of not having a valid certificate of civil liability insurance of the motor vehicle owner (motorcycle insurance), the driver will be fined from 100,000 VND to 200,000 VND according to Article 19 of the draft.
Article 19 stipulates penalties and deduction of driving license points for violations of regulations on conditions for motor vehicle drivers. Accordingly, in addition to motorbike insurance, if a motorbike driver does not have the following documents, he/she will be fined:
A fine of VND 1,000,000 to VND 2,000,000 shall be imposed on drivers of two-wheeled motorbikes with a cylinder capacity of less than 125 cm3 or with an electric motor capacity of up to 11 kW and similar vehicles to motorbikes who commit one of the following violations:
No driving license or driving license with all points deducted or using a driving license not issued by a competent authority, driving license with erasure, driving license not valid for the type of vehicle being driven;
Having an International Driving Permit issued by countries participating in the 1968 Convention on Road Traffic (except for International Driving Permits issued by Vietnam) but not carrying or not being able to present the National Driving Permit on the electronic identification account;
Using an invalid Driver's License (Driver's License with the blank number printed on the back does not match the latest blank number issued in the Driver's License management information system).
A fine of VND 4,000,000 to VND 5,000,000 shall be imposed on drivers of two-wheeled motorbikes with a cylinder capacity of 125 cm3 or more or with an electric motor capacity of over 11 kW, or three-wheeled motorbikes who commit one of the following violations:
Have a driving license but it is not suitable for the type of vehicle being driven;
No driving license or driving license with all points deducted or using a driving license not issued by a competent authority, driving license with erasure, driving license with no validity;
Having an International Driving Permit issued by countries participating in the 1968 Convention on Road Traffic (except for International Driving Permits issued by Vietnam) but not carrying or not being able to present the National Driving Permit on the electronic identification account;
Using an invalid Driver's License (Driver's License with the blank number printed on the back does not match the latest blank number issued in the Driver's License management information system).
In addition to being fined, drivers who commit this act will also be subject to additional penalties such as confiscation of a driver's license not issued by a competent authority, an erased driver's license, or an invalid driver's license.
