Decree 168/2024/ND-CP, effective from January 1, 2025. According to Article 2 of this Decree, foreigners or foreign organizations participating in traffic or traffic-related activities in Vietnam are subject to the same penalties as Vietnamese citizens when violating regulations on:
Driving in the wrong lane, running a red light.
Driving without a valid driver's license.
Using a fake driver's license.
Use alcohol, beer or stimulants while driving.
Violation of speeding and illegal parking.
Causing a traffic accident but not stopping, not reporting or fleeing.
Main penalties include:
Warning for minor or first time violations.
The fine level corresponds to the violation, specified in detail in each clause of the regulation (fines can range from 100,000 VND to 75 million VND, depending on the violation).
For example, in Article 6 of the Decree, the act of not complying with traffic light signals (running a red light) will be fined from 18,000,000 VND to 20,000,000 VND for cars; and from 4,000,000 VND to 6,000,000 VND for motorbikes.
Revoked driver's license from 1 month to 24 months.
Confiscation of exhibits and means of violation for serious or repeated offenses.
Regulations on driving licenses for foreigners
Foreigners are allowed to use an international driving license issued by the competent authority in their country, but it must be valid at the time of testing; There must be a Vietnamese translation if the English language is not used.
Additionally, if the driver's license is invalid, the violator is fined or may have his or her vehicle impounded.
Some specific penalties:
Speeding
Increase from 5 to 20km/h: fine from 800,000 VND to 1 million VND.
Increase from 20 to 35km/h: fine from 6 to 8 million VND.
Driving under the influence of alcohol
Alcohol concentration under 0.25 mg/l of breath: fine from 6 to 8 million VND
Alcohol concentration over 0.4 mg/l of breath: fine from 30 to 40 million VND and driver's license revocation from 22 to 24 months.
If you do not comply with the traffic police's orders, you will be fined from 2 to 4 million VND.
