Appraisal of the proposal for commune-level police chiefs to be fined up to 37.5 million for traffic violations

According to the draft regulations on traffic fines, the commune-level police chief has the authority to fine up to 37.5 million VND.

On August 28, the Ministry of Justice published a dossier for appraisal of the draft Decree on administrative sanctions for violations in the road sector drafted by the Ministry of Construction.

Notably, Article 18 of the draft stipulates the sanctioning authority of the People's Public Security as follows:

1. People's Public Security soldiers on active duty have the right to:

a) Fine up to VND 7,500,000;

b) Confiscation of exhibits and means of administrative violation with a value not exceeding VND 15,000,000.

2. The head of the Mobile Police unit at the company level has the right to:

a) Fine up to VND 15,000,000;

b) Apply remedial measures prescribed in Point a, Clause 1, Article 3 of this Decree.

3. The Chief of Police Station, the Head of the Mobile Police Unit at the Battalion level, the Chief of Station, and the Captain have the right to:

a) Fine up to VND 22,500,000;

b) revoking the right to use a limited-term license or temporarily suspending its operation;

c) Apply remedial measures prescribed in Point a, Clause 1, Article 3 of this Decree.

4. The commune-level police chief has the right to:

a) Fine up to VND 37,500,000;

b) revoking the right to use a limited-term license or temporarily suspending its operation;

c) Apply remedial measures prescribed in Article 3 of this Decree.

5. The Heads of the Professional Department of the Department of Administrative Management of Social Order Police include: Head of the Department of Guidance, Management of Investment and Business sectors and occupations with conditions for security, order and seals; Head of the Professional Department of the Department of Traffic Police includes: Head of the Department of Guidance on propaganda, investigation and settlement of traffic accidents, Head of the Department of Guidance, registration and inspection of vehicles, Head of the Department of Guidance, training, testing, licensing management of vehicle operators, Head of the Department of Guidance on patrolling and controlling road and railway traffic, Head of the Department of Traffic Control and Guidance, Head of the Regimental Mobile Police Department; Head of the Provincial Police Department including: Head of the Department of Administrative Management of Social Order, Department of Social Order, Department of Traffic Police, Head of the Department of Traffic Police Department: Head of the Department of Traffic Police Department.

a) Fine up to VND 60,000,000;

b) revoking the right to use a limited-term license or temporarily suspending its operation;

c) Apply remedial measures prescribed in Article 3 of this Decree.

6. Provincial Police Directors have the right to:

a) Fine up to VND 75,000,000;

b) revoking the right to use a limited-term license or temporarily suspending its operation;

c) Apply remedial measures prescribed in Article 3 of this Decree.

7. The Director of the Traffic Police Department, the Director of the Department of Administrative Management of Social Order, and the Commander of the Mobile Police Department have the right to:

a) Fine up to VND 75,000,000;

b) revoking the right to use a limited-term license or temporarily suspending its operation;

c) Apply remedial measures prescribed in Article 3 of this Decree.
