On August 18, according to the Ministry of Public Security's Electronic Information Portal, the Draft Law on Enforcement of Criminal Judgments (amended) is expected to take effect from July 1, 2026 and has transitional provisions on the work of working, vocational training, and vocational training areas outside the prison that have been approved and established according to the provisions of Resolution No. 54/2022/QH15 of the National Assembly.
Regarding the basic content of the draft Law on Enforcement of Criminal Judgments (amended), Senior Lieutenant General Le Quoc Hung - Deputy Minister of Public Security said that the draft amends and supplements many regulations related to the activities of commune-level police.
In which, it adds a provision that the Commune-level Police is the agency assigned to perform a number of criminal judgments;
Amend and supplement the tasks and powers of the People's Committee and the Commune-level Police in the direction of: The Commune-level People's Committee manages, supervises, and educates those serving criminal sentences in the community;
The commune-level police chief is responsible for assisting the commune-level People's Committees in managing, supervising, and educating people serving criminal sentences in the community.
Analyzing more in detail the contents of the supplemented and amended provisions, Deputy Minister Le Quoc Hung said that the draft Law adds 10 articles, including regulations on the duties and powers of the People's Committees at the commune level, the Commune-level Police, and the Military units in managing, supervising, and educating people whose prison sentences have been postponed or temporarily suspended; the duties of people whose prison sentences have been postponed or temporarily suspended; on the settlement of cases of prisoners wishing to donate tissues and human body parts; on the settlement of cases of community-level prisoners wishing to work and study outside their place of residence; on the content of state management of criminal enforcement.
This addition aims to solve practical difficulties, perfect regulations on the tasks and powers of agencies and units, especially commune-level police in the enforcement of criminal judgments in the community according to the organizational model of the political system and perfect regulations on the rights, obligations and regimes of those who serve judgments.
According to the draft law previously developed by the Ministry of Public Security, the Commune-level Police will perform the tasks and powers of managing and supervising people serving suspended sentences, people serving non-custodial reform sentences, ban on residence, ban on holding positions, ban on performing certain jobs or work, depriving certain civil rights; managing people whose prison sentences are postponed or temporarily suspended, people released from prison before their term with conditions; controlling people serving probationary sentences.
With a major amendment and many amendments being fundamental, it is expected that the draft Law on Enforcement of Criminal Judgments (amended) will be submitted to the National Assembly for approval at the 10th Session according to the process at one session.
