The Ministry of Construction will collect opinions until September 1, 2025 on the draft Decree on Regulations on administrative sanctions for violations in the road sector.
Article 18 of the draft stipulates the sanctioning authority of the People's Public Security as follows:
People's Public Security soldiers on active duty have the right to:
Warning fine.
Fine up to VND 7,500,000.
Confiscate exhibits and means of administrative violation with a value not exceeding VND 15,000,000.
Heads of company-level mobile police units, station leaders, and team leaders of people specified in Clause 1 of this Article have the right to:
Warning fine.
Fine up to VND 15,000,000.
Confiscate exhibits and means of administrative violation with a value not exceeding VND 30,000,000.
The police station chief, the police station chief at the border gate, the export processing zone, and the battalion commander of the Mobile Police Battalion have the right to:
Warning fine.
Fine up to VND 22,500,000.
Confiscate exhibits and means of administrative violation with a value not exceeding VND 45,000,000.
Apply remedial measures prescribed in Article 3 of this Decree.
The head of the commune-level police; the head of the professional department under the Traffic Police Department; the head of the professional department under the administrative management police department of social order; the head of the provincial police department including the head of the administrative police department of social order, the head of the traffic police department, the head of the mobile police department, and the platoon leader has the right to:
Warning fine.
Fine up to 60,000,000 VND.
revoking the right to use a license or practice certificate for a period of time or suspending operations for a period of time.
Confiscate exhibits and means of administrative violation with a value not exceeding VND 120,000,000.
Apply remedial measures prescribed in Article 3 of this Decree.
Provincial Police Directors have the right to:
Warning fine.
Fine up to 75,000,000 VND.
revoking the right to use a license or practice certificate for a period of time or suspending operations for a period of time.
Confiscate exhibits and means of administrative violation.
Apply remedial measures prescribed in Article 3 of this Decree.
The Director of the Traffic Police Department, the Director of the Department of Administrative Management of Social Order, and the Commander of the Mobile Police Department have the right to:
Warning fine.
Fine up to 75,000,000 VND.
revoking the right to use a license or practice certificate for a period of time or suspending operations for a period of time.
Confiscate exhibits and means of administrative violation.
Apply remedial measures prescribed in Article 3 of this Decree.
