The Government has just issued Decree No. 189/2025/ND-CP detailing the Law on Handling of Administrative Violations on the authority to sanction administrative violations.
The Decree clearly stipulates the authority to sanction administrative violations of: Chairman of the People's Committee, Head of the agency performing state management tasks according to the specialty, field and some other titles; Inspectorate; People's Public Security...
According to regulations, the Chairman of the People's Committee of a commune, ward, or special zone (commune level) has the right to: issue a warning; impose a fine of up to 50% of the maximum fine for the corresponding field as prescribed in Article 24 of the Law on Handling of Administrative Violations.
At the same time, the right to use a license or practice certificate for a period of time or suspend its operation for a period of time is revoked; exhibits and means of administrative violation are confiscated and remedial measures are applied as prescribed in Clause 1, Article 28 of the Law on Handling of Administrative Violations.
The Chairman of the People's Committee of a province or city (provincial level) has the right to: issue a warning; impose a maximum fine for the corresponding field as prescribed in Article 24 of the Law on Handling of Administrative Violations; revoke the right to use a license or practice certificate for a period of time or suspend operations for a period of time; confiscate exhibits and means of handling administrative violations; apply remedial measures as prescribed in Clause 1, Article 28 of the Law on Handling of Administrative Violations.
The Director of the Department has the right to: issue a warning; impose a fine of up to 80% of the maximum fine for the corresponding field as prescribed in Article 24 of the Law on Handling of Administrative Violations; revoke the right to use a license or practice certificate for a period of time or suspend operations for a period of time; confiscate exhibits and means of handling administrative violations; apply remedial measures as prescribed in Clause 1, Article 28 of the Law on Handling of Administrative Violations.
People's Public Security soldiers on duty have the right to: issue a warning; fine up to 10% of the maximum fine for the corresponding field specified in Article 24 of the Law on Handling of Administrative Violations; confiscate exhibits and means of administrative violation with a value not exceeding 2 times the fine prescribed above.
The commune-level police chief has the right to: issue a warning; impose a fine of up to 50% of the maximum fine for the corresponding field as prescribed in Article 24 of the Law on Handling of Administrative Violations; revoke the right to use a license or practice certificate for a period of time or suspend operations for a period of time; confiscate exhibits and means of handling administrative violations; apply remedial measures as prescribed in Clause 1, Article 28 of the Law on Handling of Administrative Violations.
The Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations recently passed by the National Assembly has amended and supplemented a number of points and clauses of Article 24 as follows:
Fine up to VND 30,000,000: marriage and family; gender equality; domestic violence; archives; beliefs, religions; emulation and rewards; judicial administration; population; environmental sanitation; statistics; foreign affairs; complaints, denunciations, recommendations, and reflections.
Fine up to VND 100,000,000: dykes; medical examination and treatment; cosmetics; pharmaceuticals, medical equipment; livestock farming; fertilizers; advertising; betting and games with prizes; managing overseas labor; maritime transport; civil aviation activities; managing and protecting traffic works; information technology; telecommunications; radio frequency; network security; network information security; data; digital technology industry; publishing; printing; trade; customs, tax procedures; lottery business; insurance business; practicing thrift and anti-waste; management of explosives; electricity.
Fine up to VND 500,000,000: construction; forestry; land; complex management of resources and protection of the marine and island environment; real estate business.
