Article 48 of Decree 168 stipulates the temporary detention of vehicles and documents related to drivers and violating vehicles.
Accordingly, to immediately prevent administrative violations, competent authorities are allowed to temporarily seize vehicles before issuing sanctioning decisions, typically for some of the following violations:
Driving a vehicle on the road with alcohol concentration in the blood or breath but not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath.
Driving a vehicle on the road when the alcohol concentration in the blood or breath exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath.
Driving a vehicle on the road with an alcohol concentration in the blood or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.
Failure to comply with the request for alcohol concentration testing of law enforcement officers.
Driving a vehicle on the road with drugs or other stimulants in the body that are prohibited from use by law.
Failure to comply with the request for inspection of drugs or other stimulants that are prohibited by law for use by law enforcement officers.
Driving vehicles into the highway, except for vehicles serving the management and maintenance of the highway.
Driving vehicles swerving and zigzagging on the road; using kickstands or other objects to brush against the road while the vehicle is running.
Driving vehicles in groups of 2 or more vehicles exceeding the prescribed speed.
Sit behind and wrap your arms around the person sitting in front to control the vehicle, except for carrying children under 06 years old sitting in front.
Driving in groups causing traffic obstruction, except in cases licensed by competent authorities.
Repeating the act of driving a vehicle swerving and zigzagging.
Driving a vehicle without a vehicle registration certificate (or a certified copy of the vehicle registration certificate attached to the original receipt of the credit institution, foreign bank branch in case the credit institution, foreign bank branch holds the original vehicle registration certificate) or using a vehicle registration certificate (or a certified copy of the vehicle registration certificate attached to the original receipt of the credit institution, foreign bank branch in case the credit institution, foreign bank branch holds the original vehicle registration certificate) that has expired or expired.
Using a vehicle registration certificate (or a certified copy of the vehicle registration certificate attached to the original receipt of a credit institution, foreign bank branch in case the credit institution, foreign bank branch holds the original vehicle registration certificate) that has been erased; using a vehicle registration certificate (or a certified copy of the vehicle registration certificate attached to the original receipt of a credit institution, foreign bank branch in case the credit institution, foreign bank branch holds the original vehicle registration certificate) that does not match the frame number, engine number (engine number) of the vehicle or is not issued by a competent authority.
Driving vehicles without license plates (for types of vehicles that are required to have license plates); attaching license plates that are not in accordance with vehicle registration certificates or attaching license plates not issued by competent authorities.
People also need to note that when a vehicle is temporarily seized according to regulations, the vehicle owner must bear all costs for using other vehicles to replace it to transport people and goods transported on the temporarily seized vehicle.
In case when temporarily detaining an administratively violating vehicle, but the vehicle operator or vehicle owner is not present at the place of the violation or is present but does not comply with the request of the person authorized to temporarily detain or does not meet the requirements and conditions according to regulations to control the vehicle or the vehicle does not ensure technical safety and environmental protection quality according to regulations, the person authorized to temporarily detain shall carry out the relocation of the violating vehicle to the place of temporary detention according to regulations; if not meeting the conditions for implementation, the person authorized to temporarily detain is allowed to hire organizations or individuals to carry out the relocation of that vehicle. The vehicle operator or vehicle owner who violates must pay the cost for hiring the relocation of that vehicle to the place of temporary detention.
