The Ministry of Public Security is seeking comments until October 1, 2024 on the Draft Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points and restoration of points on driving licenses.
Article 15 of the draft stipulates penalties and deduction of driving license points for drivers of motorbikes, mopeds (motorbikes), and other types of vehicles similar to motorbikes and other types of vehicles similar to motorbikes who violate regulations on vehicle conditions when participating in traffic.
Accordingly, motorcyclists will be fined from 100,000 VND to 200,000 VND for one of the following violations:
Driving a vehicle without a horn; license plate light; brake light; or without a functioning rearview mirror on the driver's left side.
Driving a vehicle without signal lights or with lights that do not work.
Using a horn that does not meet technical standards for each type of vehicle.
Driving a vehicle without a muffler or smoke reducer or one that does not meet environmental standards for emissions and noise.
Driving a vehicle without low or high beam lights or with lights that are ineffective or do not meet design standards.
Driving a vehicle without a braking system or one that is ineffective and does not meet technical standards.
Drive the vehicle with the lights facing towards the rear of the vehicle.
A fine of VND 800,000 to VND 1,000,000 shall be imposed for one of the following violations:
Driving a vehicle without a vehicle registration certificate as prescribed or using an expired vehicle registration certificate.
Using a vehicle registration certificate that has been erased; using a vehicle registration certificate that does not match the vehicle's chassis number or engine number or is not issued by a competent authority.
Driving a vehicle without a license plate (for vehicles that are required to have a license plate); attaching a license plate that does not match the vehicle registration certificate or attaching a license plate that is not issued by a competent authority.
Driving a vehicle with an improper license plate; attaching a license plate with unclear letters or numbers; attaching a license plate that is bent, covered, or damaged; painting or adding stickers that change letters or numbers or change the color of letters, numbers, or license plate background.
A fine of VND 2,000,000 to VND 3,000,000 shall be imposed for one of the following violations:
Driving a temporarily registered vehicle beyond the permitted scope and duration;
Driving a vehicle manufactured or assembled in violation of traffic regulations.
In addition to being fined, the driver who commits the violation shall also be subject to the following additional penalties:
Violation of regulations will result in confiscation of the whistle.
Violation of regulations will result in confiscation of vehicle registration certificate, license plate that is not in accordance with regulations or has been erased.
Committing an act in violation of regulations in the case of not having a vehicle registration certificate or using a vehicle registration certificate not issued by a competent authority, with incorrect chassis number or engine number of the vehicle or with erasure without being able to prove the origin of the vehicle (without documents, certificates of vehicle ownership transfer or documents, certificates of legal vehicle origin) will result in confiscation of the vehicle.
In addition to being fined, motorcyclists who commit some of the above acts will have their driving license deducted 2 points.
