According to the provisions of Clause 4, Article 5 of Decree 73/2024/ND-CP, the budget for implementing salary reform and implementing the bonus regime for civil servants and employees in public service units of Group 1 and Group 2 is guaranteed by the unit itself according to the provisions of Decree No. 60/2021/ND-CP dated June 21, 2021 of the Government regulating the financial autonomy mechanism of public service units and documents amending, supplementing and replacing Decree No. 60/2021/ND-CP.
Readers ask: Can public service units in group 3 pay bonuses under Decree 73/2024/ND-CP to non-civil servants and if so, what funding should be used to implement the bonus regime for employees under Decree 73/2024/ND-CP of the Government?
The Ministry of Finance responds to this issue as follows:
Article 2 of Decree No. 73/2024/ND-CP stipulates the subjects of application of the Decree, including the subjects of employees who are not civil servants of public service units.
For example, people working under the labor contract regime as prescribed in Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government on contracts for some types of work in administrative agencies and public service units that are subject to application or have agreed in the labor contract to apply salary classification according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces...).
Regarding funding sources. Implement according to the provisions of Decree No. 73/2024/ND-CP; Circular No. 62/2024/TT-BTC dated August 20, 2024 of the Ministry of Finance guiding the determination of needs, sources and methods of expenditure for implementing the basic salary and bonus regime according to Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government and adjusting monthly allowances for commune cadres who have quit their jobs according to Decree No. 75/2024/ND-CP dated June 30, 2024 of the Government, including regulations on funding sources for implementation for group 3 units.
