The National Assembly has passed the revised Law on Civil Servants. The new law takes effect from July 1, 2026.
According to the newly passed Law, civil servants are entitled to salaries, bonuses and other income based on the results and work efficiency according to the job position.
At the same time, they are entitled to overtime pay, night work wages, work fees and other regimes according to the provisions of law and internal spending regulations of the unit.
Officials working in mountainous areas, border areas, islands, remote areas, ethnic minority areas, areas with particularly difficult socio-economic conditions or in arduous, toxic, dangerous jobs, or specific career fields are entitled to preferential policies according to the provisions of law.
The law also stipulates that civil servants are allowed to sign labor contracts or service contracts with other agencies, organizations and units if the law on sectors and fields does not prohibit or ensure that there are no conflicts of interest as prescribed by the law on corruption prevention and control, is not contrary to the agreement in the work contract and does not violate professional ethics.
In case there is no agreement in the work contract, it must be agreed in writing by the head of the public service unit; for the head of the public service unit, it must be agreed in writing by the direct superior.
To practice as an individual if the law on the industry or field does not prohibit, ensures no conflicts of interest as prescribed by the law on corruption prevention and control and does not violate professional ethics.
To exercise other rights in business activities if not contrary to the provisions of the law on professional activities and the provisions of competent authorities...
Notably, the newly passed Law stipulates the rights of civil servants to rest and other rights.
It clearly states that civil servants are entitled to annual leave; holidays, Tet, personal leave, and unpaid leave according to the provisions of the law on labor.
In case the employee does not use or does not use all the annual days off due to work requirements, he/she will be paid a sum of money for the days off according to the internal spending regulations of the unit and in accordance with the financial capacity of the unit.
In addition, civil servants are also allowed to study and conduct scientific research at home and abroad, and participate in socio-economic activities, except in some cases.
In case of civil servants who are injured or died while performing their duties, they will be considered for the same regime and policies as war invalids or will be considered for recognition as martyrs according to the provisions of law.
The above regulation is similar to the regulation in the Law on Cadres and Civil Servants, which was also passed by the National Assembly in June 2025.
Accordingly, cadres and civil servants are entitled to annual leave, holidays, Tet, personal leave, and unpaid leave according to the provisions of the law on labor.
In case the staff and civil servants do not use or do not use all the annual days off due to task requirements, in addition to salary, they will also be paid an additional amount equal to salary for the days off.
