All of which are of public land origin and are recovered without auction
According to the report of the authorities of Khanh Hoa province, the Trimet Nha Trang - Bay View Park tourist and resort hotel complex, apartments for sale and rental and the Nha Trang Hotel project (No. 7 Hoang Hoa Tham Street, capital of 180 billion VND) are both on the list of projects invested with non-budgetary capital in the area.
These are 2 projects originating from public land but not auctioning land use rights, which is not in accordance with the provisions of the Land Law. Khanh Hoa provincial authorities have a plan to reclaim these two projects.
However, these two projects are related to the Van Thinh Phat Group case.
At the request of the Ministry of Public Security (2023), the State Bank of Vietnam (2024) with the content: "Consider temporarily suspending land recovery/project for real estate in the area related to the case that is being handled until there is a final verdict from the competent state agency according to the provisions of law", therefore, after the final verdict; the old Department of Planning and Investment (now the Department of Finance of Khanh Hoa province) will base on the regulations to advise the People's Committee of Khanh Hoa province.

Chaos at golden land projects
Regarding the origin of public land of the Nha Trang Hotel project invested by Khanh Hoa Materials Joint Stock Company, the land was previously used by Nha Trang Freshwater Plant and handed over to Nha Trang Materials Supply Station (in 1979).
In 1998, Khanh Hoa province decided to transfer state ownership of land plot No. 7, Hoang Hoa Tham street to Khanh Hoa Materials Company (later renamed Khanh Hoa Materials Joint Stock Company) for use before leasing land to this company to pay annual land rent (in 2003) and use it for office purposes and hotel business. The leased area is 3,093m2 with a lease term until 2033.
In 2016, Khanh Hoa province decided to allocate land for lease until 2066, with a one-time payment form, the purpose of land use is Commercial and Service Land. Also in this year, Khanh Hoa Materials Joint Stock Company paid land use fees of more than 18.7 billion VND.
As for the Trimet Nha Trang - Bay View Park tourist hotel, tourist apartment complex project, with a total investment of 375 billion VND, over 2 hectares. To date, Trimet - Nha Trang Joint Stock Company has paid more than 60.5 billion VND in land rent at one time (2017).
This is a project located in the golden land of Nha Trang coastline but has been behind schedule for many years. This project started in June 2015, put into operation in June 2017 before extending the progress until the end of 2018.
In reality, the investor has implemented the construction of fences, construction of the project management board's housing area, survey drilling, construction of experimental piles and load-bearing compressors. However, the project has not yet implemented the environmental impact assessment report, has not been granted a construction permit...
