However, up to now, the Regional Planning Project has not been updated and adjusted; there has not been a consensus with the Ministry of National Defense on zoning planning.
Because there is no basis to determine the value of the counterpart land fund; there is no basis to adjust BT contracts according to the conclusion of the Government Inspectorate.
Meanwhile, Phuc Son Group is being investigated by investigation agencies (Ministry of Public Security, Ministry of National Defense).
Khanh Hoa also considered the case where due to some force majeure conditions, investors could not continue to implement and were forced to terminate the BT contract.
However, up to now, there are no specific regulations and instructions on handling the workload that the investor has carried out as well as terminating the BT project contract.
From there, Khanh Hoa assessed that the completion of the difficulties and obstacles of the 3 BT projects is likely to be prolonged and will have to wait for handling according to the conclusion of the investigation agency and the court's verdict.
The Ministry of National Defense has not yet handed over a part of the BT land fund
Regarding site clearance for the BT project (project of Routes and intersections connecting Nha Trang airport), there are currently no conditions for construction, especially the land funds of the National Defense agencies have not been handed over to the locality to continue implementing the project.
The handling viewpoint of Khanh Hoa province is to recommend that the Prime Minister give instructions to the Ministry of National Defense to urgently organize the handover of the National Defense land area ( Regarding site clearance for the BT project) used by units under its management in the locality.
This is to speed up the project implementation progress, ensuring the project's investment efficiency. At the same time, unify zoning plans and detailed plans to serve as a basis for determining land prices and managing this airport land fund.
Propose that the Ministry of Planning and Investment supplement the content of problems in adjusting the feasibility study report related to the total investment; the content of specific instructions on handling the workloads that investors have carried out as well as the procedures for terminating BT project contracts in case of force majeure...
In May 2024, the Criminal Investigation Agency of the Ministry of National Defense requested the locality to provide information and documents related to the use of land funds at the old Nha Trang Airport to pay for BT projects implemented by Phuc Son Group.
