1. Receive complete apartment handover documents
When receiving the handover of an apartment building, buyers need to pay special attention to the handover documents to ensure that they have complete documents to avoid difficulties in the process of using the apartment as well as resolving arising disputes.
Accordingly, the apartment handover dossier may include:
- The contractor's handover dossier to the investor;
- Documents handed over from the investor to the Apartment Management Board;
- Handover documents to home buyers.
2. Establishment of a Minutes of Apartment handover
Clause 2, Article 124 of the Construction Law clearly states that the handover of construction works must be recorded in a record. Therefore, the parties need to prepare a Minutes of handover of the apartment when handing over the house.
3. 6 important items to check when receiving apartment handover
- Power system: Including central power panels, lighting systems, sockets in all areas such as bedrooms, living rooms, toilets, dry yards, etc.
- Water system: The water system will often be concentrated in toilets, balconies, washing machines and kitchen shelves. Buyers should open the hoses, connect them, and discharge them to see if the devices are operating normally.
- Drainage system: Pour water into the floor of toilets and balconies to check if the drainage is working well, if there is water stagnation...
- Hoardproof: Check ceilings, walls, especially bathroom walls, drying balconies... to check for cracks and water seepage...
- Other equipment: floor tiles, doors, walls, ceilings, railings, fire alarm equipment...
- Apartment area: Based on handover minutes, technical documents. Buyers can check whether the apartment area is in accordance with the documents they have received and handed over...
4. Rights of apartment buyers
According to Clause 1, Article 10 of the Housing Law 2023, home owners who are domestic organizations, households, and individuals and overseas Vietnamese have the following rights:
- Have the intangible right to a house under their legal possession.
- Using housing for residential purposes and other purposes not prohibited by law.
- To be granted a Certificate of Housing under their legal ownership according to the provisions of this Law and the law on land.
- Selling, leasing, buying, donating, exchanging, inheriting, mortgaging, contributing capital with housing according to the provisions of this Law...
- Use public utility works in that residential area together according to the provisions of this Law and other relevant legal provisions.
- Maintain, renovate, demolish, and rebuild houses according to the provisions of this Law and the law on construction.
- Receive protection of house ownership rights as prescribed in Article 7 of this Law.
- Complaints, denunciations, and lawsuits for violations of their legal ownership rights and other violations of housing laws.
5. problems with apartment warranty
Article 85 of the 2023 Housing Law clearly states that the following items will be included in the apartment warranty list. Specifically, the warranty will include steps to repair and overcome the damage of:
- Wastewater system, incineration supply system, electrical system, water, phosphorus tank.
- General works such as: Floors, walls, columns, girders, ceilings, roofs, terraces, partitions, stairs, tiles, and trays.
- Repairing major damages such as: Sinking, sinking, cracking, house collapse.
- Repairing or repair other contents as agreed in the house sale and rental contract.
