On July 1, news from the Department of Agriculture and Environment of Khanh Hoa province said that it had reviewed the case of Mr. Nguyen Van Lai (born 1954, residing in Nam Nha Trang ward) regarding the area of 140,380m2 (more than 14ha) of land managed and used by his family that was not compensated when the State recovered it.
Previously, Mr. Nguyen Van Lai said that his family had reclaimed the pond area with an area of more than 14ha and had confirmation papers from Vinh Thai commune in 1993, 1994, 1998.
He also said that this land area was appraised drawings by the Khanh Hoa Provincial Land Registration Office in 2021.
However, when the State implemented land recovery, his family was not compensated for land.

Through reviewing dossiers in June 2026, the Department of Agriculture and Environment of Khanh Hoa province identified the origin and land use process of Mr. Nguyen Van Lai and Ms. Nguyen Thi Xinh based on management dossiers, cadastral maps, planning through periods...
The results showed that Mr. Lai's household took over and used the land from 1988. However, by the time of mapping the cadastral map in 2015, this area was still identified as river land, managed by the State.
Regarding the documents provided by Mr. Lai, functional agencies assessed that there are inconsistent contents regarding the location, origin, and time of land use; there are contradictions in the process of land use fluctuations.
For the land area that Mr. Lai took over and used from 1988, there is no basis to apply land compensation and support policies according to current regulations.
However, to ensure the rights of the people, Nam Nha Trang ward has proposed to the provincial level to consider applying other support policies to Mr. Nguyen Van Lai's family.
Based on this proposal, the Department of Agriculture and Environment of Khanh Hoa province and the People's Committee of Khanh Hoa province agreed to support in the direction of applying a unit price equal to 3 times the price of agricultural land of the same type in the current land price list of the province.
The area supported does not exceed the limit for allocating agricultural land to individuals as prescribed in Article 176 of the 2024 Land Law...

Through the case, functional agencies propose that households and individuals whose land is recovered, if they do not agree with the applied policy, people should exercise the right to complain and petition in accordance with the correct order and procedures, accompanied by dossiers and legal grounds.
