The People's Committee of O Dien commune (Hanoi) has responded to the petitions of households in cluster 6, Phan Long village, O Dien commune regarding compensation policies when the State recovers land to implement the Tay Thang Long road construction investment project (section from Ring Road 3.5 to Dan Hoai canal road).
Regarding the determination of the nature of Thuong Hoi road, the People's Committee of O Dien commune said that according to the provisions of the Road Law No. 35/2024/QH15 effective from January 1, 2025, commune roads (inter-communal roads) are roads connecting the administrative center of the commune with villages, hamlets, hamlets, villages, hamlets (hereinafter referred to as villages) and rural residential areas or roads connecting to neighboring communes; roads have an important position for the socio-economic development of the commune.
Thuong Hoi road has a starting point intersecting with Dan Phuong - Tan Hoi road (belonging to old Tan Hoi commune) and an ending point intersecting with Provincial Road 422 (belonging to old Tan Lap commune), therefore it is identified as an inter-commune traffic road outside the above roads belonging to Lien Ha and Tan Hoi communes (before arrangement) specified in Section 42, Appendix 9 of Resolution 52/2025/HĐND.
Regarding the location for determining land prices, based on Article 3 of Resolution 52/2025/NQ-HĐND, land plots in cluster 6, Phan Long village do not have any sides of the land plot adjacent to the road, alley, or street on the price list.
According to regulations, the unit price of roads, alleys, and streets named in the nearest price list must be applied. Therefore, the proposal to apply the unit price according to the unit price of Dan Phuong - Tan Hoi road or Provincial Road 422 is unfounded.
Regarding the location of the resettlement land lot draw, after the General Land Plan for subdividing plots for resettlement in area A8 is approved, the Commune People's Committee will issue a Regulation on the resettlement lot draw according to the principle of equal ranking: Households belonging to which locations when land is recovered (location 1, location 2, location 3, location 4) will draw together for the corresponding land plots in that location group.
Regarding the time for handing over the resettlement land plot: For households committing to hand over the land plot before June 30, 2026, the Commune People's Committee will arrange resettlement in area A8 and commit to handing over the resettlement land plot before October 1, 2026.
For households that do not agree to hand over the land before June 30, 2026, they will resettle in the resettlement area approved in principle by the City People's Committee (belonging to area A6-2 Tan Hoi).
Also according to the People's Committee of O Dien commune, the Tay Thang Long road project is not in the group of projects according to points a, b, clause 3, Article 3 of Resolution 254/2025/QH15, so households are not supported for temporary residence according to regulations.
However, to create conditions for households to soon stabilize their lives and ensure the progress of site handover before June 30, 2026 according to the Conclusion Notice of the Hanoi City Party Committee, the People's Committee of O Dien commune will apply and approve a plan to support house rental for households who are actually living and must relocate with a support level, specifically:
Support period: 3 months; support level: 2,500,000 VND/person actually living on the land plot/month; or 5,000,000 VND/single household/month.
Maximum support level: Not exceeding 15,000,000,000 VND/recovered residential land plot/month.
The project to build the Tay Thang Long road was approved for investment policy by the Hanoi City People's Council in Resolution No. 30 dated December 8, 2021 and approved by the City People's Committee in Decision No. 5841 dated November 15, 2023.
The road through O Dien commune is 5.8km long, the starting point connects to Ring Road 3.5, the ending point intersects with Dan Hoai canal road.
The project is designed with a speed of 80km/h, with a total investment of 1,298 billion VND. The total land area recovered for project implementation is about 23.8ha.
