The People's Committee of Bac Ninh province has just issued an official dispatch on giving comments on amending the Housing Law in 2023 and Decree No. 100/2024/ND-CP dated July 26, 2024 detailing a number of articles of the Housing Law on the development and management of social housing (Decree 100).
The official dispatch sent to the Prime Minister; The Ministry of Construction said that currently, the 2023 Housing Law and Decree 100 have helped localities such as Bac Ninh speed up the development of social housing, many subjects have received social housing, and stabilized their lives.
However, through the process of building and developing social housing, the People's Committee of Bac Ninh province found that there are still some contents that are not suitable for the actual operation of social housing buildings. Specifically:
Clause 4, Article 23 of Decree No. 100, regulates the business area of services and trade in social housing projects.
According to the People's Committee of Bac Ninh province, in reality, after arranging the floor area for commercial business to a separate block of the project, the arrangement of social housing buildings in the remaining social housing buildings in the project with social housing on the first floor has caused many problems when households here organize business and trade, affecting order, fire prevention and fighting...
To resolve the above shortcomings, the People's Committee of Bac Ninh province proposed that the Ministry of Construction study and amend Clause 4, Article 23 of Decree No. 100:
"In case the social housing construction investment project has many blocks, the investor can choose to arrange them in each block or combine the entire floor area for service and commercial business of each block of the house into the floor area for service and commercial business of one or a few blocks of the house.
After arranging the entire commercial floor area into one block, the remaining social housing blocks are allowed to arrange floor area on the first and second floors for business, services and trade without including in the planning quota".
According to the People's Committee of Bac Ninh province, this amended plan will help:
Reducing the selling price of social housing (due to the general cost of social housing being allocated 1-2 more floors of commercial floors);
Have a basis to improve the quality of services for residents of social housing buildings;
Create conditions to increase profits for investors, contributing to attracting resources for social housing development.
Benefits for state management after social housing buildings come into operation, avoiding the phenomenon of transforming social housing on the first floor with the purpose of turning them into commercial and service businesses after a period of living.
Bac Ninh is the leading locality in the country in social housing development - according to the assessment of the Ministry of Construction.
According to the Prime Minister's 1 million social housing projects, Bac Ninh province is assigned to invest in the construction of at least more than 135,000 apartments for workers and low-income people.
According to the Department of Construction of Bac Ninh province, there have been 71 social housing projects in the province with a total land area of about 255 hectares. When completed, the projects will meet about 9.12 million m2 of floor space with about 102,390 apartments.
Of these, 26 projects have been completed, 5 projects have been partially completed with a total of 20,726 apartments. The remaining 45 projects are being implemented; organizing compensation and site clearance for investment and construction.
