Citizens should send questions to the Ministry of Agriculture and Environment about the following cases: Citizens are carrying out procedures for reissuing the Land Use Rights Certificate (red book) due to loss. The old red book was issued by the People's Committee of District A in 1999. The application has been submitted to the "one-stop" department and there is an appointment to return the results from August 5, 2024.
After checking, the Branch of the Land Registration Office determined that the old red book was granted an incorrect plot number, and said that the correct authority belonged to the agency that issued the first book, the People's Committee of District A (according to Point b, Clause 1, Article 152 of the 2024 Land Law).
However, up to now, the district level has been reorganized, the dossier has been suspended for nearly a year, and citizens do not know which agency is responsible for handling this case.
Responding to this content, the Ministry of Agriculture and Environment said that, based on the provisions of Point o, Clause 1, Article 133, Clause 2, Article 136 of the 2024 Land Law, the authority to reissue the Certificate due to loss is under the authority of the Land Registration Office or Branch of the Land Registration Office. The procedures for reissuing the Certificate due to loss shall comply with the provisions of Section VIII, Sub-And. C, Part V, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 2 levels, decentralization and delegation of authority in the land sector.
Regarding the procedure for correcting the issued Certificate, it is stipulated in Section XIV, Section C, Part V, Appendix I issued with Decree No. 151/2025/ND-CP.
In Clause 6, Article 18 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government regulating basic land investigation; registration and issuance of Certificates of land use rights, ownership of assets attached to land and the Land Information System, it is stipulated that in case the registration ungitor needs to carry out many procedures for land registration and assets attached to land at the same time, the procedures handling agencies are responsible for coordinating with competent authorities to resolve the matter.
Because this is a case of simultaneous implementation of 2 procedures for reissuing the Certificate due to loss and correcting the issued Certificate with errors, the procedure handling agency is responsible for contacting competent authorities to resolve the issue.
The Ministry of Agriculture and Environment informs citizens to know and contact competent authorities in the locality for implementation.
