The Ministry of Agriculture and Environment received a petition from voters in Lam Dong province with the content: Voters in Da Teh 3 commune proposed to remove the word "Ho" in the land use right certificate to create convenience for people when carrying out procedures related to land (such as giving, donating, transferring...).
Regarding this proposal, the Ministry of Agriculture and Environment would like to report as follows: According to the 2024 Land Law, the concept of "households using land" only applies to cases that were formed before the 2024 Land Law took effect. From the date the 2024 Land Law takes effect, there is no longer a regulation that "households" are a land user, specifically:
- Clause 5, Article 135 of the 2024 Land Law stipulates that in case the land plot belongs to the household's land use rights, a Certificate of land use rights, ownership of assets attached to land shall be issued with the full name of the member with common land use rights of the household on the Certificate of land use rights, ownership of assets attached to land, if the members with common land use rights of the household have needs, a Certificate of land use rights, ownership of assets attached to land shall be issued with the name of the household representative on the Certificate of land use rights, ownership of assets attached to land without writing the name "Ho Ong ..." or "Ho Ba ..." as before.
Article 259 of the 2024 Land Law stipulates the handling of land use rights of households before August 1, 2024 (the date the 2024 Land Law takes effect).
Accordingly, households using land determined according to the provisions of land law before the effective date of this Law are allowed to participate in land law relations as groups of land users with common land use rights without participating as the subject "Hogar"; when a competent state agency performs land allocation and land lease to households to implement the approved compensation, support, and resettlement plan, it must specifically record the individuals who are family members with land use rights in the land allocation and land lease decision; households allocated land by the State without land use fees, allocated land with land use fees, and leased land before the effective date of this Law when the land use term expires, land use is extended in the form of land allocation and land lease to individuals who are family members of that household.
Thus, the 2024 Land Law has regulations to remove the word "Ho" in land use right certificates, creating favorable conditions for people when carrying out procedures related to land.
