On the Government Portal, Ms. H.T.M in Da Nang said that to supplement the application for a first red book for purchasing resettlement land, she hired a company with the function of practicing cadastral map surveying to measure the cadastral position of the land plot.
After completing the survey documents, the company submitted the documents to the Branch of the Land Registration Office for consideration and appraisal, and signed the documents. The inspector has inspected the drawing documents and the actual land plot, which is currently in the stage of being submitted to the competent authority for approval.
However, it has been nearly 3 months since submitting the application, and Ms. M has not yet received the results. When contacted, she was told by the staff that she had not yet been instructed to sign for approval, the dossier did not have an official dispatch from the Department of Agriculture and Environment, and did not know which measurement company it was, so she did not sign. In addition, it is not known how inspection and appraisal fees are implemented, or which unit is implementing them.
Ms. M asked, according to current regulations, can you hire an organization with the function of practicing cadastral map surveying to conduct cadastral map surveying of a plot of land? Which competent authority confirms and approves the product of land use measurement for land plots carried out by organizations with the function of practicing cadastral map surveying?
Is it correct that the competent authority refuses to sign the approval confirmation on the grounds that there is no document guiding the process of signing the approval of land survey products for plots of land carried out by organizations with the function of practicing cadastral map measurement and the dossier does not have an official dispatch requested by the Department of Agriculture and Environment, so it should refuse to do so?
What will be the dossier for submitting for approval of land use measurement products for land plots by organizations with the function of practicing land map measurement for implementation? How are inspection and appraisal fees implemented? Which unit collects?
Is there currently any document guiding the process of signing and approving land use cadastral survey products for land plots implemented by organizations with the function of practicing cadastral map survey?

The 2024 Land Law has stipulated the documents and procedures for the first issuance of red books for individuals, communities, and households using land (in Section I, Sub-A, Section II, and Section V, Sub-A, Part V, Part C of Appendix No. I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the determination of the authority of local authorities at 02 levels, decentralization and delegation in the land sector).
Accordingly, at Point a, Clause 3, Section II, Secretary C, Part V of Appendix No. I issued with Decree No. 151/2025/ND-CP mentioned above, it is stipulated that:
"The People's Committees at the commune level organize the implementation of the following tasks:
General maps for places where maps have been available.
For places where there is no cadastral map and in the dossier for registration and issuance of a Certificate of land use rights and ownership of assets attached to land there is a cadastral map measurement piece, then check and sign to confirm the cadastral map measurement piece according to regulations, except in cases where the cadastral map measurement piece has been confirmed by the People's Committee at the commune level or the Branch of the Land Registration Office checked and signed before July 1, 2025; in case the dossier for registration and issuance of a Certificate of land use rights and ownership of assets attached to land does not have a cadastral map measurement piece, the measuring unit is required to have a Certificate of surveying activities, establish a cadastral map to conduct the measurement of the cadastral maps; the measuring unit is responsible for conducting cadastral map measurement within no more than 05 working days from the date of issuance of the commune's request for payment, and the commune's request for payment.
The Ministry of Agriculture and Environment would like to inform you and contact the competent authority in the locality for consideration and resolution in accordance with the provisions of law.
In case she does not agree with the results of the settlement of administrative procedures, she has the right to complain and file a lawsuit against administrative decisions and administrative acts on land management according to the provisions of Article 237 of the Land Law.
