A resident in Gia Lai reflected the case of a family applying for a Certificate of Land Use Rights (red book) for many years but being entangled in the process of exemption and reduction of land use fees related to their father being a war invalid.
According to the reflection, the family was allocated land and built a house from 2003 and after many applications, the 115 m2 residential land was just approved for red book issuance in April 2026.
However, the garden land was fined for encroachment, and the right to exemption and reduction of land use fees for the father - who has a 61% reduction in working capacity - is still a concern for the family.
Regarding this issue, the Ministry of Finance replied that the policy of exemption and reduction of land use fees for people with meritorious services to the revolution (including wounded soldiers, sick soldiers...) is stipulated in the law related to people with meritorious services and is only implemented when there is a decision from a competent State agency allowing exemption and reduction of land use fees according to the law on people with meritorious services.

According to Clause 9, Article 17 of Decree No. 103/2024/ND-CP of the Government (amended and supplemented by Decree No. 291/2025/ND-CP), the exemption and reduction of land use fees to implement housing and residential land policies for people with meritorious services is implemented in accordance with the law on people with meritorious services and is only implemented when there is a decision from a competent State agency.
The Ministry of Finance also clearly stated the current policy of exemption and reduction of land use fees for people with meritorious services implemented according to Decree No. 131/2021/ND-CP submitted to the Government for promulgation by the Ministry of Home Affairs. The determination of beneficiaries of this right belongs to the functions, tasks and responsibilities of functional agencies in localities in the process of reviewing land dossiers.
Thus, even if they are war invalids and are subject to preferential treatment according to the law on people with meritorious services, the right to reduce land use fees when issuing a red book is only applied when there is a decision from a competent authority and complete supporting documents.
The Ministry of Finance requests people to contact local functional agencies to be considered and resolved according to regulations and complete related procedures.
