A resident in Ho Chi Minh City said that he is learning about the procedures for issuing a Certificate of Land Use Rights (red book) for the first time but is wondering which agency currently has the authority to resolve dossiers according to new regulations.
Regarding this content, the Ministry of Agriculture and Environment said that the authority to issue Certificates of land use rights and ownership of assets attached to land has been stipulated in the 2024 Land Law and guiding decrees for implementation.
According to current regulations, the Provincial People's Committee has the authority to issue Certificates of land use rights and ownership of assets attached to land to domestic organizations, religious organizations, affiliated religious organizations, foreign organizations with diplomatic functions, people of Vietnamese origin residing abroad, economic organizations with foreign investment capital and other subjects as prescribed by law.

Notably, the Provincial People's Committee is allowed to authorize the land management agency at the same level to carry out the issuance of Certificates in some cases.
For domestic households and individuals, overseas Vietnamese who are Vietnamese citizens and residential communities, the authority to issue red books belongs to the commune-level People's Committee according to new regulations.
The Ministry of Agriculture and Environment added that this decentralization of authority is to be consistent with the two-level local government model and promote decentralization in the field of land.
In addition to the issue of the certificate issuing agency, the order, procedures and components of dossiers for carrying out land procedures are also currently decentralized to the provincial-level People's Committees as prescribed by Decree No. 49/2026/ND-CP.
According to records, many people still confuse the authority of the commune-level People's Committee, Land Registration Office and provincial-level land management agencies when carrying out procedures for first-time red book issuance.
Functional agencies recommend that people should contact the local land management agency directly for specific guidance on dossiers, procedures and competent authorities to receive and resolve according to each case.
