The Ministry of Construction has just issued Decision No. 949/QD-BXD on announcing amended and supplemented administrative procedures in the field of construction activities according to regulations on cutting and simplifying administrative procedures under the management functions of the Ministry of Construction. This Decision takes effect from July 1, 2026.
Regarding commune-level administrative procedures, Decision No. 949/QD-BXD details the procedures for issuing new construction permits for grade III and grade IV works (Non-line works/in-line works in urban areas/beliefs, religions/monuments, magnificent paintings/phases for non-line works/phases for linear works in urban areas/projects) and individual houses. Accordingly, the implementation procedures are as follows:
- The investor submits a dossier requesting a construction permit to the commune-level Public Administration Service Center.
- Within 7 working days from the date of receiving the dossier, the competent authority issuing the construction permit for level III and level IV works must organize dossier appraisal, on-site inspection, and notify the investor in writing once to supplement and complete the dossier if documents are missing, documents are not in accordance with regulations or not in accordance with reality. The construction permit issuing agency is responsible for inspecting the conditions for issuing construction permits as prescribed in Article 50 of Decree No. 175/2024/ND-CP. The inspection is carried out as follows:
+ Coordinate the conformity of the construction design drawing in the construction permit application dossier with the basic design appraised by the specialized construction agency and stamp confirmation for works under projects requiring appraisal of feasibility study reports at specialized construction agencies;
+ Check the conformity of the construction design drawing in the construction permit application dossier with the approved construction design drawing on fire prevention and fighting of the competent authority for construction works subject to fire prevention and fighting appraisal requirements;
+ Inspect the completeness and validity of the appraisal result report (if any) for works that require design appraisal according to the provisions of Decree No. 175/2024/ND-CP amended and supplemented in Decree No. 105/2025/ND-CP and Decree No. 144/2025/ND-CP.
- Within 5 working days from the date of receiving the supplementary dossier but not meeting the requirements according to the written notice, the competent authority issuing the construction permit is responsible for notifying in writing to guide the investor to continue completing the dossier. In case the supplementation of the dossier still does not meet the contents according to the notice, within 3 working days from the date of receiving the supplementary dossier, the competent authority issuing the construction permit is responsible for notifying the investor of the reason for not issuing a construction permit for grade III, grade IV works.
- The competent authority issuing the construction permit shall compare the conditions according to the provisions of the Construction Law to send a document seeking opinions from the relevant state management agency. Within 12 days from the date of receiving the dossier, the state management agencies consulted are responsible for responding in writing to the contents under their management functions. After the above deadline, if these agencies do not have opinions, they are considered to have agreed and must be responsible for the contents under their management functions; the construction permit issuing agency shall base on current regulations to decide on the issuance of construction permits for grade III and grade IV projects.
- Within 10 working days (or 7 working days for individual houses) from the date of receiving complete and valid dossiers, the competent authority is responsible for considering issuing construction permits for grade III and grade IV works.
