The State Authority for Construction Quality Inspection (Ministry of Construction) has just processed the petition of citizen H.V. N on the Information System for receiving and processing reflections and petitions on legal normative documents of the Ministry of Justice, related to regulations on sanctioning administrative violations for acts of not having a labor safety logbook or a logbook not fully recorded as prescribed.
The content of the petition is as follows:
Clause 1, Article 32 of Decree 16/2022/ND-CP stipulates: "Violating regulations on safety in construction: A fine of between VND 10,000,000 and VND 20,000,000 shall be imposed for the act of not having a labor safety logbook or a logbook not fully recorded as prescribed".
Appendix IIa of Decree 207/2026/ND-CP stipulates the construction construction logbook. In which, in item b) there is content: "Detailed description of incidents, damages, labor accidents, other arising issues and measures to overcome and handle during construction (if any)".
In fact, there is no document regulating the safety diary model. Is there a safety section in the construction diary that can be merged into one book? Does the safety diary model stipulate the signing component and content of the diary model in which document? Currently, each unit implements a different type, some places sign internally, some places sign between supervision consultants, investors and contractors. Please guide the Ministry to organize and individuals to implement uniformly.
After research, the State Authority for Construction Quality Inspection has the following opinions:
1. In section 2. 1. 13 QCVN 18:2014/BXD National Technical Regulation on Construction Safety stipulates: "The construction site must have a labor safety logbook and fully record the situation of incidents, accidents, remedial measures and handling during construction". QCVN 18:2021/BXD National Technical Regulation on Construction Safety has been issued (effective from June 20, 2022), replacing QCVN 18:2014/BXD. In QCVN 18:2021/BXD there is no regulation on labor safety logbooks.
2. Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government stipulating penalties for administrative violations in construction has expired from the date Decree No. 339/2026/ND-CP dated August 26, 2026 of the Government stipulating penalties for administrative violations in the fields of construction, management of technical infrastructure works, management, housing development, real estate business takes effect (from August 26, 2026). In Decree No. 339/2026/ND-CP, there are no regulations on penalties for administrative violations for acts of not having a labor safety logbook or a logbook that does not fully record according to regulations.
Based on the above regulations, it is proposed that citizens study and implement them according to the provisions of law.
