On the Ministry of Construction's Information Portal, reader N.T. L. P wondered:
Clause 1, Article 24 of Decree No. 06/2021/ND-CP on inspecting the acceptance of construction works stipulates:
Construction works must be inspected by competent State agencies specified in Clause 2 of this Article for acceptance during construction and when construction works are completed according to the provisions of Clause 45, Article 1 of Law No. 62/2020/QH14, including:
a) Construction works belonging to nationally important projects; large-scale, complex technical works as prescribed in Appendix VIII of this Decree;
b) Construction works using public investment capital;
c) Works that have a great impact on safety and community interests according to the provisions of law on project management of construction investment in addition to the works mentioned in points a and b of this clause".
In 2025, my unit was allocated a estimate of 500 million VND from the funding source to support the arrangement of administrative units (non-autonomous regular expenditure source), to implement the project of repairing and upgrading the public administrative service center. The project was approved by the Ward People's Committee for an economic and technical report.
I want to ask: After the project is completed, does the specialized construction agency need to inspect the acceptance of the construction project according to regulations?
Answering this question, after research, the State Authority for Construction Quality Inspection (Ministry of Construction) has the following opinion:
According to the provisions of Clause 4, Article 123 of the Construction Law No. 50/2014/QH13 amended and supplemented in Clause 45, Article 1 of Law No. 62/2020/QH14 amending and supplementing a number of articles of the Construction Law and Clause 1, Article 24 of Decree No. 06/2021/ND-CP of the Government detailing a number of contents on quality management, construction and maintenance of construction works, construction works belonging to nationally important projects, large-scale works, complex techniques; works that greatly affect safety and community interests; works using public investment capital must be inspected for acceptance during construction and when construction works are completed.
In which, the list of works that greatly affect safety and community interests is specified in Appendix III of Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government stipulating decentralization and delegation of power in the field of state management of the Ministry of Construction.
Therefore, Ms. N.T. L. P needs to base on the provisions of law on public investment, the decision to approve the construction investment project and the provisions of law on decentralization and classification of construction works at the time of project approval to serve as a basis for determining the subjects of inspection of acceptance work by specialized construction agencies according to the above regulations.
