I am learning about Decree No. 100/2024/ND-CP on social housing development. I would like to ask, according to Clause 2, Article 38, how is the proportion of apartments for 5 priority groups (people with meritorious services to the revolution, relatives of martyrs, people with disabilities, resettled people, women) determined? Is it a sum of the total valid dossiers of all 5 groups compared to the total registered dossiers of the project, or is it only calculated for the group of people with meritorious services and relatives of martyrs?
Is there a specific calculation formula? Is the investor allowed to arrange apartments for 5 priority groups lower than the determined and announced ratio?
Regarding this content, the Department of Housing and Real Estate Market Management (Ministry of Construction) has the following opinions:
Point d, Clause 1, Article 79 of the 2023 Housing Law stipulates:
“đ) In case one subject enjoys many different support policies, they are entitled to one support policy at the highest level; in case the subjects have the same standards and conditions, support is implemented in the order of priority first for: people with meritorious services to the revolution, relatives of martyrs, people with disabilities, people arranged for resettlement in the form of buying or renting social housing, women”.
Article 34 of Decree No. 54/2026/ND-CP dated February 9, 2026 of the Government amending and supplementing a number of articles of decrees in the field of housing and real estate business stipulates:
...h) In case the project has priority subjects as prescribed in point d, clause 1, Article 79 of the Housing Law, it is prioritized to buy social housing without having to draw lots with the number of apartments equal to the total number of eligible dossiers of these priority groups out of the total number of eligible dossiers in the list specified in this clause multiplied by the total number of apartments/social housing houses expected to be sold.
Prioritizing female subjects is applied to cases where the applicant is a single female or must be the head of household of the household based on the residence database.
Priority subjects specified in point d, clause 1, Article 79 of the Housing Law are arranged apartments/houses in the following order: people with meritorious services to the revolution, relatives of martyrs, people with disabilities, people arranged for resettlement in the form of buying social housing, women. In case the number of priority subjects in 1 group exceeds the number of remaining priority apartments/houses, a draw is conducted between those priority subject groups, and the remaining subjects continue to participate in the draw along with the non-priority subjects".
