Cao Bang voters proposed that the Ministry of Construction specifically study the list of urgent and emergency works to protect land such as fences, landslide protection embankments... that are exempt from construction permits in urban areas.
This regulation needs to be integrated into the Decrees guiding the Construction Law No. 135/2025/QH15, allowing people to proactively protect their assets from natural disasters under the supervision (post-inspection) of local authorities.
After studying, the Ministry of Construction would like to answer as follows:
Emergency and urgent construction works are works subject to the provisions of Article 70 of the Construction Law No. 135/2025/QH15.
Urgent and urgent construction works are exempt from construction permits according to the provisions of point a, clause 2, Article 43 of the Construction Law No. 135/2025/QH15.
Currently, the Ministry of Construction is researching and drafting the content of the Decree detailing the Construction Law No. 135/2025/QH15.
Accepting the opinions of the National Assembly Delegation of Cao Bang province, the Ministry of Construction will study to specifically stipulate the process and order of implementing investment in urgent and urgent construction projects as a basis for implementation.
It is expected that the Decree will be promulgated and take effect from July 1, 2026, in line with the effective date of the Construction Law.
