Reader H.T. K. P in Ho Chi Minh City asked: "My house is located in a part of the La Xuan Oai road project, the remaining land area is 24.9 m2.

I want to ask to build the remaining area after site clearance and handover for the project. Because the remaining area is small, 24.9 m2, my family wants to build up to 1 ground floor and 1 floor to have enough living space. I would like to ask, is my family exempt from construction permits according to the regulations of the Ministry of Construction? The house already has a red book".

After research, the Department of Economics - Construction Investment Management has the following opinions:

Contents regulating cases of construction permit exemption according to the provisions of Clause 2, Article 43 of the 2025 Construction Law (the content of this clause takes effect from January 1, 2026). It is requested that citizens study and apply it, and if necessary, contact the competent authority issuing construction permits in the locality for specific guidance.
