Reader T.M. N asked: "I graduated from university in 2015 and have been involved in construction activities for 10 years. My previous practicing certificate was valid for 5 years (2019-2024), now it has expired.
I have submitted a dossier requesting re-issuance of the Certificate for design of agricultural and rural development works (irrigation) class III according to Decree No. 175/2024/ND-CP. I have declared enough 5 class IV similar works that have been implemented, but the dossier review unit said that there are 2 works (out of 5 declared works) implemented in 2024, compared to the current time, it is not enough 2 years of experience, while I have participated in construction activities for a long time and implemented these works when the old certificate was still valid.
Please ask, is the application review unit's refusal to issue certificates as above correct according to Decree No. 175/2024/ND-CP?
After research, the Department of Economics - Construction Investment Management has the following opinions:
According to the provisions of Clause 5, Article 79 of Decree No. 175/2024/ND-CP: "The time of experience participating in work in accordance with the provisions of Clause 2 of this Article is calculated from the time the individual participates in construction activities as shown in the application for issuance/conversion of professional certificate or labor contract or confirmation from the employer or social insurance or similar documents".
Accordingly, the determination of experience time is counted as the process of participating in construction activities according to the above regulations, not the time to perform each specific task.
