On the Government Portal, Mr. T.N.T in Hanoi expressed that his unit is implementing the construction design after the basic design. Currently, Circular No. 12/2021/TT-BXD only regulates the determination of rental costs for appraisal with the basic design.
Mr. T asked, for the design implemented after the basic design, how is the cost of hiring organizations and individuals participating in the appraisal determined, and will it be included in the total investment or not?
The Ministry of Construction responds to this issue as follows:
The appraisal of construction designs implemented after basic designs has been stipulated in Article 43 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Construction Law on construction management.
Accordingly, during the appraisal process, the investor or the specialized agency under the investor, the specialized agency for construction is invited to invite organizations and individuals with appropriate expertise and experience to participate in appraisal of construction designs implemented after the basic design.
Costs for organizations and individuals participating in the appraisal shall be implemented according to the provisions of Clause 7, Clause 8, Article 13 of Decree No. 10/2021/ND-CP dated February 9, 2021 of the Government on management of construction investment costs and other relevant regulations.
