The Ministry of Construction drafted a Decree amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing.
Explaining the need to amend this regulation, the Ministry of Construction said that, in the new context, some contents in Decree No. 100/2024/ND-CP are no longer suitable for practice.
Typically, the regulation on income conditions for buying and renting social housing is stipulated in Clause 1, Article 30 of Decree No. 100/2024/ND-CP that needs to be amended.
The reason is that in the past, the Ministry of Construction has received many opinions and recommendations from a number of localities, organizations and individuals proposing to increase the income level of beneficiaries of social housing support policies to remove income barriers, creating conditions for low-income people without housing to access, buy and rent social housing.
Therefore, the Ministry of Construction proposes to increase the income level: In case the petitioner is unmarried or divorced but has not remarried or is confirmed to be single, the actual average monthly income received is not more than 20 million VND (In case the petitioner is married according to the provisions of law, the petitioner and his/her husband (spouse) have a total average monthly income actually received not more than 40 million VND) calculated according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works. In case of not being married or or or divorced but not remarried or confirmed as single and raising children under the age of majority, the average income shall not exceed 30 million VND calculated according to the Salary and Salary Table confirmed by the agency, unit or enterprise where the subject works.
Regulations on interest rates for loans for purchase and lease of social housing through the Social Policy Bank as prescribed in Clause 4, Article 48 of Decree No. 100/2024/ND-CP also need to be adjusted.
Reason: Currently, the interest rate for social housing loans according to Decree No. 100/2024/ND-CP is 6.6%/year (equal to the lending interest rate for poor households prescribed by the Prime Minister in each period). This interest rate is currently higher than the lending interest rate applied to subjects under other programs.
Implementing the direction of Prime Minister Pham Minh Chinh at the Conference to review the implementation of social housing development targets for the first 7 months of 2025 and the implementation plan for the last 5 months of 2025, the Ministry of Construction proposed to stipulate as follows: Interest rates for loans for buying and renting social housing are 5.4%/year; interest rates for lending for construction or renovation and repair of houses are equal to lending interest rates for poor households as prescribed by the Prime Minister in each period.
Therefore, amending and supplementing a number of articles of Decree No. 100/2024/ND-CP is necessary, promptly overcoming some difficulties and problems arising in practice as well as ensuring synchronous consistency with relevant laws as well as promoting the supply of social housing in conjunction with the implementation of the Project to invest in the construction of at least 01 million social housing apartments for low-income people and industrial park workers in the period of 2021-2030, while contributing to removing difficulties for the real estate market, helping the market develop more stably and healthily, while ensuring the effectiveness at the same time as the effective date of the Housing Law in accordance with the provisions of the Law on Promulgation of Legal Documents.
