According to Clause 1, Article 18 of Decree 71/2024/ND-CP, the types of land that need to determine the area in the land price list include:

- Agricultural land, residential land in rural areas.

- Commercial and service land in rural areas.

- Land for non-agricultural production and business is not commercial or service land in rural areas.

- Land for building agency headquarters, land for building public works, land used for public purposes and other non-agricultural land in rural areas.

Instructions for determining land location in building land price list

Determining land location in the construction of land price list according to Article 20 of Decree 71/2024/ND-CP is as follows:

- Basis for determining land location in building land price list

+ For agricultural land groups: Land location in the construction of land price list is determined by each area and implemented as follows:

++ Location 1 is the location where the land plots have the most favorable factors and conditions.

++ The next locations are locations where the land plots have less favorable factors and conditions than the previous adjacent location.

+ For non-agricultural land: Land location is determined in connection with each road, road section, street, street section (for urban residential land, urban commercial and service land, non-agricultural production and business land that is not urban commercial and service land), road, road section or area (for non-agricultural land types specified in Clause 1, Article 18 of Decree 71/2024/ND-CP) and based on the conditions of technical infrastructure, social infrastructure, advantages for production and business; distance to political, economic and commercial centers in the area and implemented as follows:

++ Location 1 is the location where the land plots have the most favorable factors and conditions.

++ The next locations are locations where the land plots have less favorable factors and conditions than the previous adjacent location.

- Pursuant to the provisions of Clause 1, Article 20 of Decree 71/2024/ND-CP and the actual situation in the locality, the Provincial People's Council shall prescribe specific criteria for determining the location for each type of land and the number of land locations in the land price list. For land plots and land areas with favorable or unfavorable factors in land use, the Provincial People's Council shall prescribe an increase or decrease in the price as follows:

+ For commercial and service land, non-agricultural production and business land that is not commercial and service land with high profitability, with advantages in using land as production, business, trade and service premises; agricultural land in residential areas, within the administrative boundaries of wards, based on local reality, the Provincial People's Council is allowed to prescribe higher land prices.

+ For residential land plots with more or less favorable factors affecting land price compared to residential land plots with the same land location in the land price list, the Provincial People's Council shall base on the actual situation in the locality to regulate the increase or decrease of the price.
