Types of agricultural land not granted red books
According to Point a, Clause 1, Article 151 of the 2024 Land Law, land users are not granted Certificates of land use rights and ownership of assets attached to land (red books, pink books) for agricultural land used for public purposes.
Specifically:
- Agricultural land funds used for public purposes that have been established according to the provisions of land law over the periods will continue to be used to serve the public needs of the locality.
- Agricultural land fund used for public purposes of communes, wards and towns for the purpose of building cultural, sports and physical training facilities...; compensation for people whose land is recovered when building cultural, sports and physical training facilities, cemeteries...
- Agricultural land fund used for public purposes of communes, wards, towns... approved by competent authorities.
- For the land area not used for the above purposes, the People's Committee at the commune level shall lease it to individuals for agricultural production and aquaculture through auction. The lease term shall not exceed 10 years.
Cost of making red book for agricultural land
+ Registration fee:
According to Article 5 of Decree 140/2016/ND-CP, the basis for calculating registration fees is the registration fee calculation price and the registration fee collection rate (%).
Formula for calculating registration fee payable = Registration fee calculation price x 0.5%.
+ Fee for granting red book for agricultural land:
Currently, the red book issuance fee is decided by the People's Council (PC) at the provincial level, so the collection rate for each province and city may be different (According to Clause 5, Article 3, Circular 85/2019/TT-BTC).
+ Application appraisal fee:
The fee for appraising the application for a red book is under the authority of the provincial People's Council, so the collection rate for each province and city is different.
+ Land use fee when issuing red book for agricultural land:
Depending on each case, land users will be exempted from agricultural land use fees or not.
