When must the transfer of the red book be re-measured?
When transferring a plot of land but the previously issued red book is not based on a cadastral map or is subject to the need to issue a new red book, the Land Registration Office will re-measure the area. The measurement cost is paid by the land user according to regulations.
If the land plot has reduced in area due to natural landslides, the Land Registration Office will measure and re-determine the area. The measurement cost is paid by the State.
In short, when transferring the name but the land plot must be divided, it is mandatory to re-measure. When transferring the entire plot of land, the measurement is only carried out when the land user has a request or when the competent authority discovers changes in boundaries and areas.
In addition, Point 1.1.1, Clause 1, Article 17 of Circular 25/2014/TT-BTNMT stipulates the adjustment of cadastral maps in the following cases:
New land plots and subjects occupying land appear (except for subjects such as constructions, construction and assets on land).
Change the boundaries of land plots and subjects occupying land (except for subjects being construction works and assets on land).
Change the land plot area.
Change of land use purpose.
Change information about the legal status of the land plot.
Changes in administrative boundaries and lines at all levels.
Changes in cadastral coordinates and national coordinates.
Changes in boundaries and safety corridors of works.
Changes in place names and notes on maps.
Facility for editing cadastral maps.
Changes in land plot boundaries, land plot area, land use purpose.
The administrative boundary markers and routes on the map are adjusted and supplemented when there is a decision to change the administrative boundary, establish a new administrative unit or when the dossier has been completed and the markers are placed on site.
Coordination markers, planning markers and construction safety corridors are updated on the map when new markers have been set up on site and have been notified by competent authorities.
The adjustment of information on place names, orientation geosphere and related properties shall be carried out by the land management agency when detecting changes.
