Pursuant to Clause 1, Article 5 of Decree 102/2024/ND-CP, the following regulations on land groups for housing construction are made:
Residential land is land for housing and other purposes serving life in the same plot of land. Residential land includes rural residential land, urban residential land, specifically as follows:
a) Rural residential land is residential land within the boundary of the commune administrative unit, except for residential land that has implemented a new urban construction project according to the urban and rural system planning but is still within the boundary of the commune administrative unit;
b) Urban residential land is residential land within the boundaries of administrative units of wards and towns and residential land within the boundaries of commune administrative units that have implemented new urban construction projects according to the urban and rural system planning.
Accordingly, land for housing construction belongs to the non-agricultural land group.
Pursuant to Clause 1, Article 8 of Decree 71/2024/ND-CP, factors affecting land prices for housing construction are stipulated as follows:
Factors affecting land prices for housing construction according to current regulations include:
- Location, location of the land plot, land plot;
- Traffic conditions: width, road surface structure, adjacent to 1 or more road surfaces;
- Conditions for water supply and drainage, electricity supply;
- Area, size, shape of land plot, land plot;
- Factors related to construction planning include: land use coefficient, construction density, construction boundary, construction height limit, limit of basements built according to detailed construction planning approved by competent state agencies (if any);
- Current environmental and security status;
- Land use term;
- Other factors affecting land prices in accordance with actual conditions, cultural traditions, and local customs and practices.
