What is pond soil?
According to the Land Law 2024, the concept of “pond land” is not specifically defined as a separate type of land. The classification of pond land use is determined based on the purpose of use and location of the land plot.
- Pond land in a plot of land with a house
According to Article 103 of the 2024 Land Law, garden and pond land located on the same plot of land with a house can be recognized as residential land. The determination of residential land area in this case is based on factors such as the time of formation of the land plot, documents on land use rights and the land recognition limit prescribed by the Provincial People's Committee.
- Pond land outside the residential plot
For pond land located outside of residential land plots, it is often classified as agricultural land and used for aquaculture purposes or other agricultural activities.
Converting pond land use to residential land
The conversion of pond land use to residential land must comply with regulations on land use planning and be permitted by competent State agencies.
According to Article 116 of the 2024 Land Law, the conversion of land use purposes, including pond land to residential land, must be based on the following two factors:
- Approved district-level land use planning.
People who want to convert pond land use to residential land need to go to the local Land Registration Office or Department of Natural Resources and Environment to see planning information. In particular, people need to determine whether their pond land is included in the residential land use planning or not.
- Land use needs are stated in the application for change of land use purpose.
If the land is in the new residential land use planning, it can be converted.
Speaking to Lao Dong reporter, lawyer Truong Anh Tu (TAT Law Firm) said: “Pond land to be converted to residential land must be located in the residential land planning area. The dossier includes: Application for land use purpose conversion, land use right certificate and current status drawing. Land use fee is calculated based on the price difference between pond land and residential land.”
The lawyer also recommended that people contact the local environmental resources agency to check the detailed conversion conditions and cost estimates before submitting the application.
