Pursuant to Point b, Clause 3, Article 220 of the 2024 Land Law, the term of land use when merging land plots is regulated as follows:
- In case of conformity of different land plots on land use purposes, land use term, land rent payment, it is necessary to implement simultaneously with procedures for changing land use purpose, adjusting land use term, transferring the form of land rent to unify for a purpose, a land use term, a form of land rent in accordance with the law.
Therefore, the determination of land use term when merging land plots is carried out at the same time as the procedure for changing land use purposes.
In addition, according to Article 173 of the 2024 Land Law, the land use term when changing the specific land use purpose is regulated as follows:
- The land use term for individuals when changing land use purposes is regulated as follows:
+ In case of transferring special -use forest land and protective forest land to another type of land, the deadline is determined by the deadline of the type of land after being shifted. The land use term is calculated from the time of the decision to allow the change of land use purpose;
+ In case of annual crop transfer land, perennial crops, production forest land, aquaculture land, salt making land to special -use forest land, protective forest land, the land use term is stable in the long term;
+ In case of changing the purpose of use between types of agricultural land not specified in Point a and Point b, Clause 1, Article 173 of the 2024 Land Law, the individual using the land shall continue to use the land for the period of time assigned or leased;
+ In case of transferring agricultural land to non -agricultural land, the land use term is determined by the time limit of the type of land after being changed to use. The land use term is calculated from the time of the decision to allow the change of land use purpose.
- The land use term when changing the land use purpose to implement an investment project is determined according to the provisions of Point c, Clause 1, Article 172 of the 2024 Land Law, except for the case specified in Clause 3, Article 173 of the 2024 Land Law.
- Land use term in cases of converting the purpose of use from non-agricultural land for long-term stable use to non-agricultural land for limited use or from non-agricultural land for limited use to non-agricultural land for long-term stable use is long-term stability.
