On the morning of August 19, continuing the program of the First Extraordinary Session, the National Assembly listened to the submission and appraisal report on policy orientations for amending the 2023 Housing Law.
Presenting the report, Member of the Party Central Committee, Minister of Construction Tran Hong Minh said that the draft Law supplements new regulations on 4 types of housing and corresponding legal policies for each type of housing, including: Commercial housing; rental housing; public housing; policy housing.
Regarding housing ownership, the draft stipulates "dead-end apartments" according to the term of use of construction works according to the provisions of construction law, associated with ensuring property rights. Apartment owners are entitled to fulfill financial obligations to build new apartments according to regulations when the term expires.
The draft law's orientation also supplements the BT (build - transfer) form for renovating and rebuilding apartment buildings, contributing to supplementing capital for the project of renovating and rebuilding apartment buildings.

The draft law also supplements the model of hiring professional units to perform a number of tasks of the Apartment Building Management Board to improve the quality of apartment building management and reduce the workload for the Management Board.
The draft law also supplements a new chapter on developing rental housing, including rental housing invested and built with state capital. In which, it stipulates that the subjects eligible to rent housing are Vietnamese citizens who have housing difficulties or need to rent housing.
Accordingly, the State invests in building and creating rental housing through the Housing Fund, and the VGCL is the managing agency for projects investing in building rental housing using trade union financial resources.
The capital source of the Housing Fund is formed from the state budget allocated, money deducted from the amount equivalent to the value of the land fund that has been invested in building technical infrastructure to build social housing in accordance with the law on housing.
Giving opinions on the policy orientation for amending the 2023 Housing Law, Member of the Party Central Committee, Chairman of the National Assembly's Law and Justice Committee Phan Chi Hieu said that the appraisal agency basically agreed with the 6 groups of policies that have been identified.

Regarding the general requirements for housing development, the Law and Justice Committee proposed to continue to study and review regulations on planning, strategies, and housing development programs, clarifying the relationship between housing development strategies and programs and related planning types.
Regarding term apartments, the draft Law has introduced a new concept of "term apartment". However, the Law and Justice Committee believes that the remaining articles of the draft law do not use this term but only stipulate the "term of use of apartment buildings".
The concept of "apartment building use term" and policies on renovation and reconstruction of apartment buildings in the draft Law are basically inherited from the provisions of the 2023 Housing Law.
Therefore, it is proposed to consider adding the concept of "term-limited apartment building" in the draft Law to avoid different understandings related to "term of use of apartment buildings".
Regarding policy housing, the National Assembly's Law and Justice Committee proposed to continue to study and have a mechanism to "strictly and transparently control cases that enjoy preferential housing policies, not to let policy profiteering occur; control and prevent housing speculation".
Meanwhile, regarding the management and use of apartment buildings, the Law and Justice Committee proposed to continue reviewing and proposing policies to ensure thorough removal of bottlenecks that have been pointed out.
Especially inadequacies in the management and use of apartment buildings such as disputes over common ownership - private ownership of apartment buildings, activities of the Management Board, Apartment Building Management Board.
