Location for receiving red book applications
According to the Appendix to administrative procedures in the land sector issued with Decision 2304/QD-BTNMT in 2025, people can submit applications for a red book at one of the following locations:
Public Administration Service Center; Land Registration Office or Branch of the Land Registration Office.
One-stop Department of the People's Committee of the commune where the land is located.
Through postal service.
Online on the National Public Service Portal or the Provincial Public Service Portal.
Competent authority issuing red books
The provincial People's Committee is the competent authority to issue red books for the first time to land users. The subjects of issuance include domestic organizations, religious organizations, foreign-invested enterprises and people of Vietnamese origin residing abroad.
The Land Registration Office or the Branch of the Land Registration Office shall issue new or confirm changes on the red book in case of registration of changes. These two agencies are allowed to use their own seals when performing procedures.
Procedures for issuing red books for the first time at the commune level according to new regulations
People request to register for a red book and submit the application to the Public Administration Service Center or the Land Registration Office. People submit copies and originals for officers to receive documents for inspection and comparison.
In case of submitting the application online, the application must be digitized from the original, a notarized and certified copy of the document.
Next, the authorities check the documents, issue a receipt and schedule a return of results. If the documents are not complete, the agency will return them with an additional request form according to the instructions.
The People's Committee of the commune where the land is located checks the actual land use and determines the specific boundary of the land plot. The People's Committee of the commune decides on the form of land use or cases of exemption from land use fees and rents, and at the same time sends a transfer form to determine financial obligations.
The Chairman of the Commune People's Committee signed the issuance of red books after the people had fulfilled their financial obligations. After that, the dossier with a copy of the red book is sent to the Land Registration Office to establish, update, and edit cadastral records and land database.
In case the land user is not exempted from all land use fees, the land rental fee will be transferred to the provincial level for settlement. The competent authority will decide on the form of land use, land valuation, and send a transfer form to determine financial obligations.
After that, the provincial land management agency will issue a red book after receiving a notice from the tax authority on the completion of financial obligations.
