Conditions for granting red books for agricultural land with documents
For agricultural land with full documents, if it meets the conditions prescribed in Article 137 of the Land Law No. 31/2024/QH15, it will be considered for granting a red book.
Land with land use documents established before October 15, 1993.
Households and individuals with documents of state-owned farms and forestry farms.
Households and individuals with legal documents on inheritance, donation, liquidation, and valuation.
Having one of the documents in the above cases but that document is in the name of another person.
Households and individuals are allowed to use land according to judgments and decisions of the Court and the results of mediation.
There are copies of documents in the above cases where the original is lost.
According to Clause 8, Article 137 of the 2024 Land Law, a person who is using land with one of the above documents and shows different times on it, can choose the time stated on the documents as the basis for issuing a red book.
Communities that are using land with constructions such as temples, shrines, shrines, pagodas, agricultural land, etc. will also be considered for a red book if they meet the conditions.
In case of agricultural land without documents
If the following conditions are met, the land user can still be granted a red book:
Using land before December 18, 1980, now the People's Committee of the commune where the land is located has confirmed that there is no dispute.
Using land from December 18, 1980 to before October 15, 1993, now the People's Committee at the commune level has confirmed that there is no dispute.
Using land from October 15, 1993 to before July 1, 2014, now the People's Committee at the commune level has confirmed that there is no dispute.
For land plots with multiple households and individuals sharing the land use, the residential land limit according to the above cases is calculated by the total residential land limit of those households and individuals.
Households and individuals who are eligible for agricultural land allocation, have used residential land or non-agricultural land before July 1, 2024, do not have documents on land use rights, have registered permanent residence in areas with difficult or extremely difficult socio-economic conditions, and are confirmed by the People's Committee at the commune level to have no disputes, will be granted a red book and will not have to pay land use fees.
Households and individuals who are using land stably for agricultural purposes and have been confirmed by the People's Committee at the commune level to have no disputes will be granted a red book in the form of land allocation by the State without collecting land use fees.
