The Ministry of Justice is reviewing the draft Decree guiding the collection of public opinions on the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units, which will be developed by the Ministry of Home Affairs.
Commune-level People's Committees organize public consultation by distributing Household Consultation F formats according to the Form prescribed in the Appendix issued with this Decree.
Commune-level People's Committees organize the distribution of votes to each household in forms suitable to the specific conditions of the locality, ensuring the provisions of law on implementing democracy at the grassroots level.
Regarding the reception and handling of recommendations on the results of public consultation, the Ministry of Home Affairs proposes that when detecting errors in the results of public consultation, citizens and organizations have the right to complain to the People's Committee where the results of public consultation are reported.
Within 5 working days from the date of receipt of the complaint, the People's Committee must resolve the complaint and notify the complainant of the results of the settlement.
In case errors in the results of public consultation are detected due to the process of synthesizing and reporting the results of public consultation, the People's Committees at all levels shall revise and complete the report on the results of public consultation to competent authorities according to the provisions of the Law on Organization of Local Government and this Decree.
In case of detecting errors in the results of the public consultation have been posted on the Government Electronic Information Portal, the Provincial People's Committee shall send a document to the Government Electronic Information Portal to request correction.
Within 3 working days from the date of receipt of the document from the Provincial People's Committee, the Government Electronic Information Portal is responsible for correcting the results of the public consultation.
In case the reclamant does not agree with the results of the complaint settlement or the complaint settlement deadline has expired and the complaint is not resolved, he/she has the right to file a lawsuit at the People's Court according to the provisions of the law on administrative proceedings.
