The Department of Agriculture and Environment of Ho Chi Minh City has just sent a document to the People's Committees of 168 communes, wards and special zones of Con Dao regarding the receipt of documents from enterprises that need to use land to implement socio-economic development projects.
According to Point c, Clause 3, Article 127 of the 2024 Land Law, the conditions for land use to implement socio-economic development projects, through agreements on receiving land use rights, must have written approval from the Chairman of the Provincial People's Committee.
However, Decree 151/2025/ND-CP (effective from July 1, 2025 to March 1, 2027) stipulates decentralization and delegation of authority of local authorities at 2 levels, decentralization and delegation in the field of land related to the registration and issuance of certificates of land use rights and ownership of assets attached to land to organizations managing and using houses and land according to regulations, and is transferred to the Chairman of the People's Committee at the commune level.
Thus, the Department of Agriculture and Environment believes that from July 1, 2025, the commune and ward levels will be the places where enterprises submit documents and receive initial approval decisions, instead of having to go through many levels as before. This decentralization is expected to help shorten the time for procedures and facilitate investors, especially for small-scale projects.
In addition to decentralizing the settlement of agreements on land allocation and lease without payment to implement the project, according to Decree 151 of the Government, from the beginning of July, the People's Committees of communes and wards will receive and handle 14 other land procedures such as: granting and exchanging Land Use Rights Certificates (red books); changing land use purposes with households and individuals; registering changes; certifying ownership rights; confirming cadastral maps to serve the issuance of books... along with many other real estate procedures.
The Department of Agriculture and Environment requests the People's Committees of communes, wards and Con Dao special zone, based on relevant land law regulations and laws on land use fees and land rents, to proactively receive land registration dossiers, issue certificates to review, decide on land use forms and issue certificates to land users in accordance with the provisions of law.
