The components of the application for a level 4 house construction permit are specified in Sub-section 1, Section C, Part II of the List of administrative procedures issued with Decision 864/QD-BXD in 2025, including:
- Application for a license to repair or renovate a project.
- One of the legal documents on land proving the suitability of land use purpose and ownership of the project for construction permit, including:
+ Land use right certificate is issued according to the provisions of the Land Law through the periods.
+ Certificate of land use rights and ownership of assets attached to land issued in accordance with the provisions of the law on land through the periods.
+ Certificate of house ownership and land use rights is issued in accordance with the provisions of the law on land and the law on housing through the periods.
+ Certificate of house ownership; Certificate of construction ownership has been issued in accordance with the provisions of the law on land, the law on housing, and the law on construction through the periods.
+ Documents eligible for granting certificates of land use rights, house ownership rights and other assets attached to land but not yet granted certificates include: Documents specified in Article 137 of the 2024 Land Law; or confirmation from the People's Committee at the commune level and organized land registration confirming eligibility for granting certificates of land use rights, house ownership rights and other assets attached to land according to the provisions of the law on land.
+ Land documents for cases where the State allocates land, leases land, changes land use purposes after July 1, 2004 but does not have a certificate of land use rights, house ownership rights and other assets attached to land according to the provisions of the law on land, including: Land allocation decision of a competent state agency or Land lease decision of a competent state agency and accompanying land lease contract (if any) or documents on winning auction of land use rights, auction of projects using land.
+ Report the current status of land use in cases where religious organizations and establishments are in use but have not been granted a certificate of land use rights, house ownership rights and other assets attached to land, and be inspected and handled by the People's Committee of the province where the land is located according to the provisions of Article 142, Article 145 of the 2024 Land Law.
+ Documents on the classification of historical - cultural relics, scenic spots or the list of relic inventories according to the provisions of the law on cultural heritage of the Provincial People's Committee in cases of granting construction permits to carry out new construction, repair, renovation or relocation of historical - cultural relics, scenic spots but have not been granted certificates of land use rights, house ownership rights and other assets attached to land according to regulations...
+ Other legal documents as prescribed by the law on land...
- Construction design documents:
+ For individual houses of households and individuals: 2 sets of accompanying construction design drawings; results of administrative procedures according to the provisions of the law on fire prevention and fighting; report the results of construction design examination in cases where the law on construction requires.
+ For individual houses of the organization: the construction design drawing set in the construction design documents implemented after the basic design (construction drawing design for projects only requires the preparation of an Economic - Technical Report) approved according to the provisions of the law on construction, along with the results of administrative procedures according to the provisions of the law on fire prevention and fighting; report the results of construction design examination in cases where the law on construction requires.
