What works can be built on agricultural land?
Agricultural land is a type of land allocated, leased or recognized by the State for land use rights to serve agricultural production needs such as growing rice, watching other annual crops, growing perennial crops, planting forests, etc.
Clause 2, Article 9 of the 2024 Land Law specifically stipulates that agricultural land groups include the following types of land:
- Land for growing annual crops, including rice land and land for growing other annual crops;
- Land for perennial crops;
- Forestry land, including special-use forest land, protective forest land, and production forest land;
- Aquaculture land;
- Concentrated livestock land;
- Salt soil;
- Other agricultural land.
Pursuant to Clause 7, Article 4 of Decree 102/2024/ND-CP, other agricultural land regulations include:
- Land for breeding and planting and flower and ornamental plant growing; land for cultivation, animal husbandry, aquaculture for the purpose of studying, researching, experimenting;
- Land for building greenhouses and other types of houses for agricultural and livestock purposes, including forms of agricultural and livestock farming not directly on the land;
- Land for construction of works attached to agricultural production areas including land for building motels, shelters, and camps to serve workers;
- Land for construction of works for agricultural product conservation, containing pesticides, fertilizers, machinery, tools and other auxiliary works.
Thus, users of agricultural land are allowed to build some types of works on the land, but these works must be used for agricultural purposes such as barns, warehouses, greenhouses, not for residential purposes.
In addition, Article 179 of the 2024 Land Law stipulates that agricultural land funds used for public purposes can be used for construction (this type of land according to the provisions of the 2024 Land Law is not granted a red book):
- Cultural, sports, entertainment, public health, education, markets, cemeteries and other public works invested, managed and used by the People's Committees at the commune level.
- Building houses of gratitude, houses of love, houses of great solidarity.
How to record construction information in the red book?
Pursuant to Clause 2 and Clause 3, Article 12 of Circular 10/2024/TT-BTNMT, the method of displaying information on the certificate in the case of certifying ownership of works on agricultural land is as follows:
(1) Information on land users and owners of works on agricultural land
(2) Information about the land plot
Information about the parcel of land is shown in accordance with Article 8 of Circular 10/2024/TT-BTNMT, including information on the number of land plot and land plot area; Information about the type of soil includes the name of the soil and code (symbol) of the soil type; Information about the deadline, form of land use ...
(3) Information about the project
Information about assets attached to land: shown in the QR code of the certificate.
