According to Decision No. 51/2024/QD-UBND of Cao Bang Provincial People's Committee, to rent land, people in need need to follow basic steps from submitting land lease application, appraisal and approval process, to signing land lease contract and obligations of the tenant.
When a locality in Cao Bang province has a list of land plots and land plots that can be exploited in the short term (with an extract map or cadastral measurement of the land attached), the Land Fund Development Center, the Provincial People's Committee and the District People's Committee must publicly post it on the information portal. This information is also publicly announced at the headquarters of the Commune People's Committee.
After 10 days of public information disclosure, the Land Fund Development Center will have 7 days to assess organizations and individuals eligible to lease land at the facility.
Entities wishing to lease land must submit a Land Lease Application Form 2b (attached to Decree 102/2024/ND-CP) along with a document stating the investment objectives, planned construction works on the land, proposed rental price and land lease deposit. The land lease deposit must be at least 20% of the total land lease amount during the lease term.
When leasing land, the tenant is not allowed to build permanent structures and voluntarily dismantle and dispose of crops on the land when requested and is not allowed to request compensation.
Information about eligible land lease entities will be made public within 10 days. During this period, eligible entities must pay a deposit (this amount ensures the responsibility for dismantling the project when required). If the individual or organization fails to pay the deposit within the deadline, the selection result will be canceled.
After the selected subjects pay the full deposit, within 3 days the Land Fund Development Center will sign a land lease contract according to regulations.
