Bustling advertisements for buying social housing without proving documents
Recently, along with the announcement of information about many social housing projects starting construction and opening for sale, on social networking sites, there have appeared a series of posts by real estate brokers selling social housing diplomatic quotas along with attractive offers such as no need to prove home purchase documents.
Learning about the Vinh Hung social housing project (Hanoi), even though construction has not started, many people have continuously posted advertisements for diplomatic quotas.

Posing as someone who wants to buy a house, the reporter contacted an account named Nguyen Hung (character's name has been changed) and said that he owned a diplomatic space to buy directly from the investor, a 70m2 apartment in the form of a corner house.
When asked to buy a place to live, this person said directly: "If we accept the price of 24 million VND/m2, we will meet and discuss".
After the reporter agreed, Mr. Hung said that he would buy directly from the investor and then transfer it to those in need, so the buyer did not need to meet any criteria or conditions for social housing.
Also in this project, another man named Tap Nghia (character's name has been changed) said that he has a 70m2 apartment for 28 million VND/m2, bought directly from the investor.
If the buyer agrees, the transfer of the name can be done in the next 2 weeks. This is a diplomatic position, so it does not require conditions or proof of documents, contracts are only made with handwritten documents, not notarized. When the project starts construction and signs a sales contract, buyers will have the right to choose apartments and floors.
"The buyer has deposited 100 million VND in advance to keep the place, if it is late, they will lose the place" - Mr. Nghia affirmed.
Not only at the Vinh Hung social housing project, as previously reported by Lao Dong Newspaper in many projects such as Ha Dinh Social Housing, CT3 Dong Anh Social Housing, Thuong Thanh Social Housing also recorded the situation of "brokers" taking advantage of the opportunity to sell diplomatic quotas or document services with the commitment of "guaranteed winning". However, this is just a form of fraud, targeting people's urgent need to buy a house.
The truth about social housing diplomacy
Mr. Nguyen Hoang Nam - General Director of G-Home Joint Stock Company - a company specializing in developing social housing - commented that social housing is a type of property that is only allowed to be sold to a number of subjects according to regulations. Therefore, the "broker" advertising that everyone can buy is untrue. In addition, social housing never has a diplomatic quota. If the number of registered buyers exceeds the number of apartments for sale, there will be a draw to select, especially in Hanoi and in the special type I urban areas - where drawing is almost certain to be applied. Therefore, the information that the "broker" gave about the diplomatic quota was untrue.

Mr. Nam said that for commercial housing, when eligible, investors are allowed to raise capital by selling assets formed in the future. However, for social housing, it is necessary to carry out additional steps such as publicizing information on opening for sale, receiving registration documents on the website of the Department of Construction.
Therefore, people absolutely do not believe in free brokerage. The "brokerage" of quoting 24 - 28 million VND/m2 when the project has not started or broken ground is unreasonable, because the official selling price cannot be determined.
In many big cities, there is a situation of "brokers" manipulating customer psychology for profit, because the supply of social housing is too small compared to demand. For example, in Hanoi, the current price of newly opened commercial apartments is about 70 million VND/m2. If "brokers" offer social housing for sale at prices less than half that, they are hitting the needs of buyers. But in reality, buying through "brokers" will not have any accurate information.
"The project has not started construction, the information has not been posted but the application has been received is against the process. Even if the documents have a confirmation stamp but are signed before the opening date is a violation. Buyers should not buy through "brokers". All official information must be from the investor, listed on the website of the Department of Construction with the location for receiving documents and contact phone number. Only go through the official channel, not through a floating broker" - Mr. Nam said.
He also noted that with the current personal identification management system, all fraud will be detected and strictly handled. Cases of income exceeding regulations or having a house but making false statements to buy social housing will be punished.

Buying social housing without proving documents is illegal
Dr. Dang Van Cuong - Head of Chinh Phap Law Office - said that according to Article 76 and Clause 1, Article 77 of the Housing Law 2023, the beneficiaries of social housing support policies include 11 cases such as: people with revolutionary contributions according to the decree on preferential treatment for people with meritorious contributions; poor and near-poor households in rural and urban areas; workers and laborers working in enterprises... In addition, Article 78 of the Housing Law 2023, Article 30 of Decree 100/2024/ND-CP, the conditions for buying or renting social housing are that the subjects must meet housing conditions and income conditions.

In addition, Decree 49/2021/ND-CP stipulates that social housing can only be sold to eligible subjects (income, household registration, no housing...) and is not allowed to be transferred for 5 years from the date of purchase.
Therefore, advertisements that can buy social housing without being a buyer, in cases where it is purchased according to the provisions of law are false information, information about the possibility of reselling social housing immediately after purchase is also untrue information. The subject who places false information like that will be administratively sanctioned. If he places false information like that to appropriate property, he/she may be prosecuted for criminal liability for the crime of fraud and appropriation of property.
Therefore, people absolutely do not believe in the advertising content of brokers, impersonating organizations to carry out procedures to buy social housing. If you are eligible to buy social housing, you must contact the competent authority, carry out procedures to buy a house according to the provisions of law, avoid listening to and following false information from scammers to lose money.
