The Government Office has just issued Document No. 8312/VPCP-CN conveying the direction of Deputy Prime Minister Tran Hong Ha on reviewing the legal framework related to the process and procedures applied to construction investment projects.
Accordingly, considering the proposal of the Ministry of Construction in Official Dispatch No. 8009/BXD-KTQLXD, Deputy Prime Minister Tran Hong Ha gave instructions to assign the Ministry of Construction, the Ministry of Finance, the Ministry of Agriculture and Environment, according to their assigned functions and tasks, to review and study the proposal of the Ministry of Construction in the above Official Dispatch in the process of implementing projects to amend and supplement the laws: Construction Law; Land Law; Public Investment Law; Law amending and supplementing a number of articles of the Law in the field of agriculture and environment to ensure the principles of feasibility, efficiency, and correct authority.
Study specific policy mechanisms approved by the National Assembly to remove obstacles and inadequacies in the legal system, increase decentralization, decentralization, and reduce administrative procedures in the process of developing and submitting for promulgation draft laws.
Previously, on August 7, 2025, the Ministry of Construction issued report No. 8009/BXD-KTQLXD to the Prime Minister on the legal framework related to processes, procedures, and mechanisms to accelerate the progress of important national projects. In particular, it is proposed to continue amending a number of relevant legal regulations.
Specifically, regarding the authority to inspect the acceptance of works under important national projects, the Ministry of Construction proposed to amend the subjects of inspection of the Council's acceptance work in Decree No. 06/2021/ND-CP of the Government, and at the same time review the criteria for selecting large-scale, complex technical works subject to inspection by the Council as prescribed in Appendix VIII of this Decree.
The Ministry of Construction proposes these contents along with the process of reviewing and amending the Construction Law (reportedly included in the Government's law-making program, expected to be submitted to the 15th National Assembly for consideration and approval at the 10th Session).
Regarding a number of proposals of the Ministry of Agriculture and Environment related to shortening the time for announcing land recovery for important national projects and increasing the limit of forest land and rice land use according to the increase in total investment, the Ministry of Construction proposed that the Prime Minister assign the Ministry of Agriculture and Environment to study and propose specific contents when implementing the draft Law amending and supplementing a number of articles of Laws in the agricultural sector (expected to be submitted to the 15th National Assembly for consideration and approval at the 10th Session).
