What is agricultural land located in residential areas?
Article 9 of the current Land Law Classification of 3 groups: agricultural land, non -agricultural land and unused land. In particular, each type of land is used for different purposes. Thus, the current Land Law has no regulations on agricultural land located in the residential area.
However, in reality, the use of agricultural land in residential areas is quite common, especially in large cities that people often call "interspersed land".
Because it is located in the middle of a residential area, the agricultural land area is often quite small and mainly garden land, pond land, annual crop land or other agricultural land.
With agricultural land located in residential areas, when conducting land transactions, it is often relatively complicated.
Converting agricultural land in residential areas to residential land
Clause 1, Article 121 of the 2024 Land Law stipulates that in the following cases, when changing land use purposes, permission must be obtained from the People's Committees at the district level, in which cases the land user is allowed to change the purpose of using agricultural land to non-agricultural land.
At the same time, land users must fulfill financial obligations according to regulations.
Accordingly, the conditions for the People's Committee at the district level to allow the change of land use purpose are as follows:
- In accordance with the annual land use plan of the district level approved by the competent state agency;
- The application for change of land use purpose clearly shows the need to use the land.
